About The Position

This Special Counsel Assistant Attorney General position is in the Office of the Attorney General within the Consumer Protection Division and can be worked from the Tallahassee office, or from the offices in Tampa, Orlando or Fort Lauderdale. Attorneys in the Consumer Protection Division enforce Chapter 501, Part II, the Florida Deceptive and Unfair Trade Practices Act, as well as many related state and federal consumer protection-related statutes and rules in state and federal trial and appellate courts. This Special Counsel AAG position works closely with other litigators for the Division in assisting with division litigation, taking a lead role in priority matters and complex litigation, providing guidance and advice on litigation strategy and drafting and reviewing pleadings. This position may also assist bureau management by providing back up for manager coverage to ensure the smooth day-to-day running of the office.

Requirements

  • Admission to the Florida Bar.
  • Ten (10) years of professional experience in the practice of law, in the judiciary or in teaching law or any combination thereof.
  • Five (5) of the ten (10) years must be in the specialty area in which the attorney is being hired.
  • Complete and accurate application profile necessary for qualifying such as dates of service, reason for leaving, etc.
  • All employment and/or detailed information about work experience must be listed on the application (including military service, self-employment, job-related volunteer work, internships, etc.) and that gaps in employment are explained.
  • Applicant responses to qualifying questions must be verifiable by skills and/or experience stated on the employment application and/or resume.

Nice To Haves

  • 5 or more years of experience handling civil litigation cases
  • 2 or more years of experience handling the prosecution or defense of cases involving fraud, deceptive trade practices or white-collar crime cases
  • Leadership experience and experience mentoring other attorneys
  • Experience with large case eDiscovery review

Responsibilities

  • Assisting with division litigation.
  • Taking a lead role in priority matters and complex litigation.
  • Providing guidance and advice on litigation strategy.
  • Drafting and reviewing pleadings.
  • Assisting bureau management by providing back up for manager coverage to ensure the smooth day-to-day running of the office.
  • Participating in and overseeing investigations of alleged consumer protection violations by individuals and businesses.
  • Working with a team to assist with and often oversee and direct the collection of relevant evidence; legal research; preparation of investigative subpoenas; and review of consumer complaints, investigative or other summary reports, voluminous subpoena production responses, and other case information to evaluate and effectively direct case strategy and manage case resolution or litigation.
  • Assisting others in the performance of routine administrative functions including responding to correspondence and telephonic inquiries, e-filing, attending staff meetings, maintaining time records, and preparing case status reports.
  • Independently drafting, managing, and negotiating the resolution of civil investigations and litigations, often in complex matters, requiring creative and innovative solutions involving injunctive and monetary provisions against individuals and corporate respondent(s).
  • Recommending appropriate terms to achieve meaningful relief and drafting resolution documents such as assurances of voluntary compliance, consent judgments, and mediated resolutions.
  • Initiating and managing civil litigation matters, in state and federal courts from initial filing through trial and any related appeal.
  • Conducting appropriate legal research; recommending sound legal strategy; and independently drafting memoranda of law and related briefs, initial pleadings, subpoenas, motions, and all discovery.
  • Independently conducting all related depositions, hearings, mediations, and trials as well as assisting attorney, investigative and administrative colleagues in trial, pleading, practice, and procedures as needed.
  • Representing the Department in meetings and conferences relating to consumer protection investigations and litigation.
  • Establishing and/or maintaining lines of communication with local, state and federal civil and criminal partners; processing related referrals; serving on federal or state task forces; and collaborating with such groups or agencies as appropriate.
  • Maintaining current expertise in consumer protection law, including familiarity with recent judicial decisions and applicable state or federal rules and orders.
  • Reviewing, drafting, editing, or providing feedback regarding current, pending, or anticipated legislative changes.
  • Performing all assigned tasks or responsibilities in a timely manner, which may require extended hours and/or travel outside the worksite.
  • Advanced computer use is required for the drafting and preparation of pleadings, briefs, hearing or trial notebooks, and other necessary documents.
