As Senior Counsel – Litigation, you will lead and manage complex litigation matters arising from Boston Scientific's global operations. You will oversee complex litigation, including government investigations, commercial disputes, product liability, employment, and environmental matters as a member of Boston Scientific's Litigation team. In this role, you will evaluate and advise the company on strategies for defending claims, oversee outside counsel, manage discovery and internal investigations, and protect the company's legal and business interests. You will partner closely with Compliance, Regulatory Affairs, Quality, Clinical, Finance, Accounting and Commercial teams to develop litigation and settlement strategies. The successful candidate will possess exceptional litigation judgment, the ability to navigate complex legal and business issues in a highly regulated environment, and extensive experience managing government investigations and product liability matters. At Boston Scientific, we value collaboration and synergy. This role follows a hybrid work model requiring employees to be in our local office at least three days per week. Requirements

  • Juris Doctor (J.D.) degree and admission to a U.S. state bar in good standing.
  • Minimum of 12 years' experience with the government, a large law firm, a large corporate legal department, or a combination thereof.
  • Significant experience with complex motion practice, trial preparation and trial advocacy.
  • Strong experience managing government investigations and product liability matters.
  • Demonstrated ability to provide proactive, candid legal advice and strategic counsel to senior leaders.
  • Demonstrated history of high personal integrity and a strong commitment to compliance and ethics.
  • Proven ability to build effective relationships with stakeholders while managing complex, high-risk matters.
  • Excellent communication, decision-making and problem-solving skills, with demonstrated leadership and the ability to influence cross-functional stakeholders.
  • Strong organizational, facilitation, collaboration and presentation skills, with the ability to synthesize information from multiple sources to provide objective risk assessments and practical guidance for decision-makers.
  • Self-motivated with a willingness to take ownership of issues and develop creative, practical solutions.
  • Demonstrated ability to achieve results in a highly matrixed, fast-paced environment.

  • Experience developing litigation governance tools, including policies, playbooks, standard operating procedures and best practices.

Responsibilities

  • Manage all aspects of the litigation process, including assessing risk, developing strategy, partnering with outside counsel, reviewing pleadings, preparing company witnesses, managing written discovery, attending hearings and trials, and developing and executing trial strategy.
  • Oversee responses to government investigations, subpoenas, civil investigative demands, inspections and enforcement actions involving federal, state and other regulatory agencies.
  • Coordinate internal investigations and fact-finding efforts with business stakeholders.
  • Develop investigation strategies, oversee document preservation and collection efforts, and manage interactions with regulators and enforcement agencies.
  • Advise business and functional leaders on legal risks arising from government inquiries and enforcement activities.
  • Monitor emerging enforcement trends, perform root cause analyses related to litigation findings, and recommend proactive risk mitigation measures.
  • Manage litigation budgets efficiently in a dynamic environment with strong fiscal accountability.
  • Collaborate with colleagues on dispute resolution and litigation avoidance strategies.
  • Build collaborative relationships with in-house counsel, business partners, internal clients and cross-functional teams to align on legal strategy, priorities, resources and communications.
  • Communicate directly with opposing counsel and parties during dispute resolution, as appropriate, without relying on outside counsel.
  • Partner with Finance and Accounting teams to manage litigation costs, budgets and spending trends.
  • Develop litigation tools, including policies, standard operating procedures (SOPs), best practices, playbooks, governance documents and other practice resources.
