About The Position

The Agency for Persons with Disabilities (APD) is a consumer-oriented agency responsible for supporting individuals with unique abilities and their families in living, learning, and working within their communities by creating multiple pathways to possibilities. The Fair Hearing Attorney position is in the Office of the General Counsel, providing legal representation to APD in the areas of consumer services and supports and Medicaid-related litigation in various forums before the Department of Children and Families Office of Appeal Hearings, the Division of Administrative Hearings (DOAH), as well as other state or appellate courts, as required. This role is critical to the Agency and requires coordination and communication with Agency staff, attorneys, consumers, and their representatives and caregivers. This position reports directly to the Fair Hearing Attorney Supervisor. OGC is headquartered at the State Office in Tallahassee, located within the Capital Circle Office Complex at 4030 Esplanade Way. However, APD has regional offices across the state. This position may be filled in Tallahassee, Pensacola, Wildwood, or Lakeland. The Agency recognizes the special responsibility associated with the licensed practice of law. It is a necessary implication, as a member in good standing with the Florida Bar, that you will work outside the normal work hours as necessary to provide quality representation for our clients. Due to this, and subject to workload and legal deadlines, some flexibility in hours and location to achieve a work life balance may be accommodated on a case-by-case basis.

Requirements

  • High School Diploma or its equivalent.
  • One (1) year of human resources/personnel experience.
  • Member of the Florida Bar in good standing.
  • A valid Drivers’ License or other efficient means of transportation
  • Knowledge and experience with: Public records and their exemptions, HIPAA, and laws and ethics in government.
  • Knowledge of: Legal terminology.
  • Knowledge of: Laws and legal procedure, including administrative procedures and practices.
  • Knowledge of: Microsoft Office software (Outlook, Teams, PowerPoint, Excel, and SharePoint) and Adobe Acrobat.

Responsibilities

  • Providing legal representation to APD in the areas of consumer services and supports and Medicaid-related litigation in various forums before the Department of Children and Families Office of Appeal Hearings, the Division of Administrative Hearings (DOAH), as well as other state or appellate courts, as required.
  • Coordination and communication with Agency staff, attorneys, consumers, and their representatives and caregivers.
  • Provide legal counsel and represent the Agency at the administrative level.
  • Perform legal research and prepare various legal documents.
  • Interpret state and federal legislation, laws, and rules.
  • Employ legal reasoning and to foresee possible legal problems.
  • Communicate effectively and concisely, both orally and in writing.
  • Engage in alternative dispute resolution.
  • Deal tactfully and courteously with the public, including unrepresented litigants.
  • Plan, organize, and coordinate work assignments independently.
  • Conduct meetings and to make presentations.
  • Learn and adapt to continually evolving software and technology.
