About The Position

This is highly technical and complex legal work in the Division of Licensing. This position involves reviewing investigative reports to determine if probable cause exists for administrative action against licensees or applicants. The Senior Attorney will also draft orders, provide legal representation at administrative hearings and appellate courts, assist in rule promulgation, and prepare legal opinions interpreting relevant Florida Statutes. This role provides legal guidance to supervisors and investigators within the Division of Licensing.

Requirements

  • Admission to the Florida Bar.
  • Knowledge of the principles and techniques of professional and effective communication.
  • Ability to review data for accuracy and completeness.
  • Ability to communicate effectively.
  • Ability to establish and maintain effective working relationships with others.
  • Knowledge of basic computer operations.
  • Knowledge of Chapter 493, Chapter 119, and section 790.06, F.S.

Responsibilities

  • Reviews investigative reports and determines if sufficient probable cause exists to proceed in administrative action against licensees or applicants for licensure.
  • Determines which violations should be charged based upon the evidence presented.
  • Reviews recommended orders and drafts orders for the Division Director’s signature.
  • Provides legal representation to Division of Licensing at administrative hearings before the Division of Administrative Hearings and in oral arguments before the appellate courts.
  • Performs all necessary discovery and files necessary pleadings and briefs.
  • Assists in the promulgation of administrative rules and amendments in conformance with Chapter 120, the Administrative Procedures Act.
  • Prepares informal legal opinions interpreting Chapter 493 and Section 790.06, Florida Statutes.
  • Provides legal guidance to Division of Licensing supervisors and investigators regarding all agency functions.
  • Performs other related duties as required.
