About The Position

The Office of the Attorney General is seeking a Unit Manager in the Worker Protection Unit (WPU) within the Office of Civil Rights (OCR) of the Public Advocacy Division (PAD). The Public Advocacy Division manages the affirmative civil enforcement litigation of OAG to protect the public interest. WPU investigates and litigates civil cases to vindicate the rights of Virginia workers and to hold employers accountable for violations of Virginia law, including wage theft, worker misclassification, and unlawful denials of sick leave.

Requirements

  • Licensed and admitted to practice law in the Commonwealth of Virginia (preferred)
  • Able to waive into the practice of law in the Commonwealth of Virginia (required)
  • At least seven years of civil litigation experience in Virginia state court is strongly preferred but similar litigation or other relevant experience will be considered.
  • A working knowledge of federal and state labor laws is also beneficial.

Responsibilities

  • Enforcing Virginia labor law.
  • Receiving referrals from state agencies, including the Department of Labor and Industry, regarding violations of the Virginia Minimum Wage Act and the misclassification of Virginia workers.
  • Enforcing statutes that require the provision of paid sick leave and that require salary transparency.
  • Supervising all staff in WPU.
  • Supervising all litigation brought by WPU in state circuit courts.
  • Preparation and presentation of complex civil cases before state circuit courts.
  • Planning, directing and controlling litigation activities, involving subject matter jurisdiction, adequacy and admissibility of evidence, proper application of judicial precedent, and the rules of civil procedure.
  • Working closely with state agency partners and other statewide stakeholders.
  • Advising on related bills during the legislative section.
