About The Position

Reviews first party claims such as physical damage, cargo, PIP or Medical Payments claims referred by claims examiners with subrogation potential and/or unpaid premium claims. Conducts recovery investigation and manages recovery demands within authority. Files suit for subrogation demands that are denied.

Requirements

  • Bachelor's degree in related field or equivalent work experience.
  • One or more years work experience.
  • Interpretation and application of insurance contracts
  • Insurance claim procedures, loss evaluation methods and claim resolution alternatives
  • Insurance related courses such as AIC, CPCU

Responsibilities

  • Reviews first party claims such as physical damage, cargo, PIP or Medical Payments claims referred by claims examiners with subrogation potential and/or unpaid premium claims.
  • Evaluates claims and amounts owed, determines and documents anticipated recovery.
  • Determines if third party coverage exists or assets are available by conducting an investigation, which may include obtaining statements from witnesses, insureds, and third parties and/or assigning adjusters or forensic engineers or accountants to obtain information and documents.
  • Directs independent adjusters and auditors during investigation to gather evidence to prove liability.
  • Reviews premium calculations, audit results, new evidence presented by insured, applicable legal standards, and other information to determine probable result of litigation to recover unpaid premium.
  • Makes demands by telephone or letter to the responsible parties or their insurance carrier(s).
  • Demands recovery from the insured where reimbursement is due to unpaid premium or a regulatory filing.
  • Initiates additional investigation such as ordering asset search to determine recovery potential.
  • Initiates skip traces to locate responsible parties.
  • Communicates by letter with Department of Motor Vehicles when a debtor defaults to suspend his driving privileges.
  • Contacts the local county or city attorney to make restitution part of the criminal sentence and provides the necessary evidence to document the claim.
  • Negotiates recovery of less than 100% when appropriate and within specified authority without prior approval.
  • Negotiates payment terms of promissory notes and customizes contracts for signature of debtor.
  • Consults with Manager or examiners when recovery involves difficult issues or questions about liability are to be resolved.
  • Determines when to file suit for subrogation demands that are denied.
  • Evaluates, selects, and directs attorneys during litigation and in the negotiation and settlement within established limits.
  • Submits affidavits and other required documents to attorney filing suit.
  • Maintains control of file to ensure cost effective recovery.
  • Obtains direction from Manager on difficult cases.
  • Attends mediation when required.
  • Prepare and maintain accurate and timely record of communications with Insureds, Claimants, and other third-parties.
  • Maintains a diary system to ensure prompt follow up and collection.
  • Maintains computerized databases using Claim Information Systems (CIS) to record incoming checks.
  • Determines and diaries statute of limitations date on recovery files.
  • Refers delinquent accounts to collection coordinator.
  • Closes uncollectible files when situation demands.
  • Obtain and maintain all required licenses and certifications; maintain current knowledge of insurance and claim management principles and practices through review of published opinions, trade periodicals and other professional literature and conferences.
