The New York City Taxi and Limousine Commission (TLC) is the agency responsible for regulating New York City's taxicab and for-hire vehicle industry. TLC licenses and regulates over 130,000 vehicles and more than 175,000 drivers, making it the most active taxi and limousine regulatory agency in the United States. Aside from vehicles and drivers, TLC also regulates taxicab agents and for-hire vehicle bases, including popular app-based transportation services. The TLC plays a pivotal role in furthering public safety within New York City and is a lead agency in a citywide effort to reduce traffic-related injuries. One of the largest components of TLC’s operations is the enforcement of agency and administrative code regulations. The Prosecution Division investigates and prosecutes all summonses issued by TLC which amount to over 100,000 summonses each year. Under the general supervision of the Senior Supervising Attorney and Supervising Attorney of the Adjudications Unit, with latitude for independent and unreviewed action and decision, the Prosecuting Attorney II will perform responsible legal work within the Division including serving as the Division's liaison to the Port Authority for all summonses issued in connection with Port Authority's airport enforcement of the impermissible solicitation regulations under Sections 19-506 and 19-507 of the New York City Administrative Code. The selected candidate will be designated to perform the duties of the unit's supervisor in their absence and assists in the overall supervision of the Adjudications Unit, including reviewing the work of assigned attorneys, filling in for other legal staff in emergency situations, assisting in monitoring workflow, ensuring compliance with deadlines, and preparing reports and summaries. The Prosecuting Attorney II will also be responsible for overseeing the work of attorneys assigned to Port Authority cases and other TLC cases, including appearing on behalf of the Commission at administrative hearings, and providing continuous training and guidance to officers on issuing summonses with sufficient narratives to establish rule violations, as well as ongoing prosecutor training and micro-trainings as required. The selected candidate will also prepare case files associated with summonses issued by Port Authority Police, prepare Officer testimony when necessary, and review complaints made by Airport Dispatchers. Responsibilities also include but are not limited to: assisting the managing attorney in other TLC prosecution matters and the prosecution of TLC summonses before OATH Hearings Division; conducting legal research and analyzing statutes, rules, and case law in connection with Port Authority and general TLC prosecution matters; reviewing and editing charging documents prepared by prosecuting attorneys; and overseeing the preparation of evidence and witnesses for introduction at administrative hearings.
