About The Position

Responsible for administration of EPC contracts in conjunction with project leadership, including risk identification and contract management during project execution, providing input and influence throughout the project lifecycle. Lead the development and execution of entitlement and commercial recovery strategies associated with changes, delays, disruptions, and other compensable events. Coordinate directly with the site leadership, Commercial, and Legal teams to pro-actively monitor and manage contractual terms, draft notices, and coordinate change order administration. Responsible for ensuring all contract management procedures, documentation requirements, and processes required for the project are being properly adhered to. This position is a key resource for project leadership and plays a vital role in ensuring that construction projects are completed successfully, on time, and within budget while maintaining compliance with contractual obligations and requirements. The Principal’s expertise is essential for minimizing risks and fostering positive relationships among all stakeholders involved in the project. This position will sit in our Indianapolis, IN office but will be required to travel to Indiana based projects 3-4 days out of the work to work alongside project leadership and other stakeholders.

Requirements

  • Bachelor’s degree in law, engineering, construction management or relevant discipline; or equivalent experience
  • 10+ years of recent experience in construction contract management on large and complex construction projects in the $150MM to $250MM range
  • Three+ years of recent experience in using construction management software
  • Experience participating in pre-award contract negotiations with owners, subcontractors, suppliers, and joint venture partners
  • Experience in EPC, design-build, renewable energy, transmission, power generation, industrial, or heavy civil projects
  • Experience managing commercial risk across multiple concurrent projects
  • Strong knowledge of construction contract requirements, contract change conditions, claims analysis and negotiations, change order cost estimates, and time impact analyses
  • Experience with Viewpoint, Procore, and Project Controls software
  • Subject-matter expert in contract management principles and techniques
  • Understanding of common construction agreement provisions including warranties, limits of liability, risk of loss, schedule milestones/LD’s, force majeure, and change orders
  • Ability to interpret difficult and complex contractual provisions
  • Strong organizational skills, initiative, and meticulous attention to detail
  • Excellent written and verbal communication skills
  • Advanced Microsoft Office skills (Word, Outlook, Excel)
  • Working knowledge of Primavera P6 scheduling principles and CPM schedule analysis
  • Ability to evaluate schedule impacts associated with changes, delays, acceleration, and productivity losses

Nice To Haves

  • Certified Construction Manager (CCM), Certified Professional Contract Manager (CPCM), or Project Management Professional (PMP) preferred
  • RICS, MRICS, or equivalent commercial management certification preferred
  • Certification in claims analysis or delay analysis (AACE, PSP, etc.) preferred

Responsibilities

  • Serve as the subject matter expert for complex contractual and commercial issues
  • Present commercial risk assessments and recommendations to executive leadership
  • Establish relationships with the various project operational leadership teams
  • Proactively identify potential changes and prepare forward-looking analysis and conceptual mitigation plans to keep the project leaders aware of potential issues before they arise
  • Interface directly with clients on contractual matters
  • Experience developing and executing comprehensive claims and entitlement strategies on EPC and large infrastructure projects
  • Experience preparing, evaluating, and negotiating change orders, delay claims, disruption claims, and cost recovery initiatives
  • Demonstrated experience with schedule-driven claims, critical path methodology (CPM), and delay analysis techniques
  • Experience supporting litigation, arbitration, mediation, dispute review boards, or expert consultant engagements
  • Conduct periodic audits of project compliance with notice provisions, subcontract requirements, quality documentation, insurance obligations, and payment terms
  • Draft contractual notices to subcontractors and suppliers regarding performance and other project execution related matters
  • Participate in regular project team meetings, including owner meetings, and proactively engage with the project team regarding risk assessments
  • Advise the Project Manager on the contractual change requirements including monitoring and tracking changes and claims through final resolution
  • Provide support to the Project Manager, project team, and insurance team in administering, tracking, documenting, and closing our insurance claims
  • Support project closeout to ensure all contractual requirements are met including administration of certificates and warranties
  • Capture contractual lessons learned during project execution and report out during the Close Out Phase Gate
  • Other duties as assigned
