About The Position

Thompson Law is seeking a Pre-Litigation Attorney to manage a personal injury pre-litigation docket in their San Antonio, Texas office. This role focuses on managing cases from post-intake through settlement, with mentorship from senior attorneys. The attorney will work with a team of paralegals and specialists to handle case needs and administrative tasks, allowing the attorney to focus on case facts, medicine, demand, and results. This is a pre-litigation role, not a courtroom role, and involves developing liability, coverage, and damages theories, guiding client treatment, building demand packages, driving settlement negotiations, protecting the client's net recovery, leading a team, serving as a client advocate, and growing as a personal injury lawyer.

Requirements

  • Licensed to practice law in Texas and in good standing with the State Bar of Texas.
  • 3–8 years of legal experience.
  • At least 2 years of personal injury experience (plaintiff or defense).
  • Hands-on experience evaluating liability and coverage.
  • Experience working with medical records and treatment.
  • Experience valuing claims.
  • Experience negotiating with adjusters.
  • Ability to manage a docket of cases and people, meet deadlines, and pay attention to details.
  • Clear and effective written and verbal communication skills.
  • Comfortable with legal research databases, case management software, and modern legal technology, including responsible use of artificial intelligence.
  • A desire to advocate for injured people, maximize their recoveries, and enjoy the work.

Nice To Haves

  • Experience with motor vehicle, commercial trucking, or premises liability cases.
  • Familiarity with lien and subrogation resolution.
  • Prior litigation experience.
  • Spanish speaking ability.

Responsibilities

  • Manage a docket of personal injury cases in pre-litigation, developing liability, coverage, and damages theories and moving files toward settlement.
  • Evaluate new matters by working up liability, coverage, and damages, and making recommendations on case progression.
  • Guide client treatment by working with treatment paralegals and providers to understand injuries and future care needs, ensuring medical build-up supports the case.
  • Review and approve demand packages, pressure-testing liability, confirming coverage, verifying the medical picture, and setting settlement ranges.
  • Value cases, direct negotiations paralegals, and negotiate directly with adjusters to maximize recovery, recognizing when a case should move to litigation.
  • Review reduction worksheets and final distributions, and work with lien specialists to resolve various liens.
  • Direct and support assigned paralegals and assistants, setting standards for excellence, accountability, and collaboration.
  • Serve as a trusted advocate for clients, keeping them informed and advising them on treatment, progress, and settlement decisions.
  • Learn from senior attorneys, take on increasing responsibility and case value, and contribute ideas to case building and settlement strategies.
