About The Position

The Patent Litigation Associate will serve as a key member of Bochner PLLC's Litigation and Intellectual Property practice. This role involves representing clients in complex patent litigation matters, as well as a mix of commercial and IP related disputes, across federal and state courts. The Associate will work closely with partners and litigation teams throughout all phases of litigation, including pre-suit investigation, pleadings, discovery, motion practice, claim construction, expert discovery, trial preparation, and appeals. The ideal candidate demonstrates strong legal research and writing skills, sound strategic judgment, and the ability to manage litigation workstreams in fast-paced environments. This position offers meaningful responsibility, client interaction, and opportunities to collaborate with attorneys across multiple practice areas. The role is hybrid for candidates based in the New York City area and fully remote for candidates located outside the greater NYC area.

Requirements

  • J.D. from an ABA‑accredited law school.
  • Active member in good standing of the New York State Bar.
  • 3-7 years of litigation experience, with significant exposure to patent and/or IP litigation.
  • Experience handling federal court litigation matters.
  • Strong legal research, writing, and analytical skills.
  • Ability to manage complex matters and multiple deadlines simultaneously.
  • Proficiency with Microsoft Office, Adobe Pro, and legal research platforms (Westlaw/Lexis).

Nice To Haves

  • USPTO Patent Bar admission preferred.
  • Background in science or engineering is a plus but not required.

Responsibilities

  • Represent clients in patent infringement and related IP disputes in federal court proceedings.
  • Assist with all phases of patent litigation, including pleadings, fact and expert discovery, claim construction, dispositive motions, trial preparation, and post‑trial briefing.
  • Conduct legal and technical research related to patent validity, infringement, enforceability, and damages.
  • Draft and review litigation filings, including complaints, answers, motions, briefs, discovery requests, and responses.
  • Coordinate with experts on technical issues, infringement analyses, and expert reports.
  • Support preparation for depositions, hearings, mediations, and trials.
  • Assist with PTAB proceedings, including IPRs and related USPTO matters, as applicable.
  • Support a range of commercial litigation matters, including contract disputes, business torts, and other complex commercial claims.
  • Draft pleadings, motions, briefs, and discovery materials in commercial litigation matters.
  • Conduct factual investigations and legal research to support case strategy and client counseling.
  • Assist with discovery management, including document review, privilege analysis, and production coordination.
  • Manage assigned litigation tasks efficiently across multiple active matters.
  • Track deadlines, court rules, and scheduling orders to ensure procedural compliance.
  • Coordinate with paralegals, litigation support staff, and co‑counsel.
  • Maintain organized case files and accurate matter documentation.
  • Interface directly with clients on litigation status, strategy, and procedural developments.
  • Prepare client updates, status reports, and litigation memoranda.
  • Provide clear, practical guidance aligned with client goals and risk considerations.
  • Collaborate with attorneys across practice areas, including Corporate, IP prosecution, and Employment, on multidisciplinary matters.
  • Contribute to internal knowledge management, litigation templates, and best practices.
  • Support business development efforts, including pitch materials and matter summaries.
  • Stay current on developments in patent law, IP litigation, and commercial litigation trends.
  • Ensure compliance with ethical rules, confidentiality requirements, and Firm policies.
  • Maintain accurate and timely time entries and billing documentation.
  • Perform additional litigation‑related tasks as assigned or reasonably expected of an associate attorney.
