About The Position

Hearing Officer position available in the Agency for Health Care Administration Office of the General Counsel, Fair Hearing Section. The position is full-time, requires a five-day work week (Monday through Friday), and is located in one of the following locations: Clearwater, Orlando, Tallahassee, Tampa, Florida. The position works under the supervision of the Fair Hearing Section Chief or designee. This position will be filled at $40.00 Hourly and is non-negotiable. OPS employment is a temporary employer/employee relationship used for accomplishing short term or intermittent tasks. OPS employees are at-will employees and are subject to actions such as pay changes, changes to work assignment, and terminations at the pleasure of the agency head or designee. OPS employees do not serve probationary periods or become permanent in their positions because they serve at the pleasure of the agency head. Upon commencement of employment in compliance with Agency policy, the incumbent shall receive New Employee Orientation, Plain Language, Customer Service, Sexual Harassment, Cultural Diversity, Americans with Disabilities Act (ADA), Ethics, Supervisor, Computer Security Awareness, HIPAA and Medicaid 101 training. In addition, the incumbent shall receive training in substantive legal topics such as the civil procedural and evidentiary rules, and on the Fair Hearing Section case management system, as well as other agency computer systems. SUCCESSFUL COMPLETION OF A CRIMINAL BACKGROUND INVESTIGATION IS A CONDITION OF EMPLOYMENT.

Requirements

  • Demonstrated legal research and writing skills
  • Knowledge of civil and/or administrative litigation procedures
  • Familiarity with administrative rulemaking

  • Ability to work either independently or collaboratively, as required
  • Admission to the Florida Bar with membership in good standing
  • Two (2) years of professional experience in the practice of law, legal research and writing, judicial and legal clerk or internships, teaching law or in administrative judicial hearings
  • Florida Bar licensure

  • Knowledge of the Medicaid program
  • Administrative and/or civil litigation experience

Responsibilities

  • Conduct fair hearings for Medicaid programs administered by the Agency for Health Care Administration under the authority of section 409.285, Florida Statutes and 42 C.F.R. §431, Subpart E, & 42 C.F.R. §438, Subpart F.
  • Handle all aspects of assigned Medicaid fair hearing proceedings including case management, conducting the fair hearings and rendering written final orders for the agency, subject to appellate review.
  • Provide legal opinions on assigned topics based on identification of relevant facts, thorough legal research and careful analysis.
  • Identify potential legal concerns relevant to the operation of the Fair Hearing Section and communicate such concerns to the Fair Hearing Section Chief or designee.
  • Assist in the analysis, implementation and development of legislation relevant to the mission and operation of the Fair Hearing Section.
  • Interpret and apply state administrative rules and federal regulations pertinent to Medicaid fair hearings.
  • Assist in the development of administrative rules necessary for Medicaid fair hearings and the operation of the Fair Hearing Section.
