About The Position

This position is with the Utah Department of Commerce, Division of Real Estate. The role involves investigating potential violations of the Real Estate Licensing and Practices Act and leading a team of Real Estate Investigators. The work is primarily complaint-driven and requires conducting interviews, reviewing documentation, writing comprehensive investigative reports, and communicating effectively with complainants and respondents. The position will initially be in the office for training, with potential for telework up to two days per week after eligibility requirements are met. The agency is the Department of Commerce, which serves as the licensing and registration agency for Utah's professional and business community, overseeing various sectors including real estate.

Requirements

Willingness to place real estate license (if applicable) on inactive status.
Experience working in the real estate industry.
Experience in preparing reports, documentation, and communications.
Background in roles that required effective communication and interpersonal skills, especially in handling inquiries or complaints.
Proven experience educating and training others.
Proficiency with Microsoft Word and Excel or their Google equivalents (Docs and Sheets).
Valid driver's license required to drive a motor vehicle on a highway in this state per UCA53-3-202(1)(a).
Must successfully pass a criminal history check.
All work must be performed while physically within the state’s borders.
Eligible to work in the United States. Sponsorship for employment visa is not available.
Employees shall receive compensatory time off in lieu of payment in cash for all overtime worked under the Fair Labor Standards Act (FLSA).

Nice To Haves

Experience as a licensed Real Estate agent or broker providing a solid understanding of industry practices and terminology.
Investigative experience, previous work in a role that required investigative skills, such as in law enforcement, compliance, fraud investigation, or regulatory oversight.
Lead, Supervisor or Manager experience.
Conducting fact-finding interviews demonstrating the ability to gather and analyze information effectively.
Legal or regulatory experience, working with legal documents, contracts, or in a regulatory environment, providing a strong foundation for understanding complex legal and compliance issues.
Project or case management experience, managing multiple cases or projects simultaneously, demonstrating organizational skills and attention to detail.

Responsibilities

Conduct detailed and consistent investigations of complaints to ensure compliance with Statute and Rules.
Receive, research and respond to incoming questions or complaints; provides information on statutes and rules, and/or facilitates a resolution.
Manage a high-volume caseload with meticulous attention to detail and excellent organization skills.
Act as an expert witness, giving testimony and recommendations in court cases and/or hearings.
Oversee a team of investigators, including hiring, determining workload and delegating assignments, training, reviewing and monitoring and evaluating performance, initiating corrective or disciplinary actions.
Facilitate seamless communication and collaboration between the Chief Investigator.
Create and deliver training material, presentations, newsletter articles to educate staff, management, licensees and/or the general public and industry members.
Evaluate operational workflows and systems through regular reviews to ensure efficiency and adherence to established policy and standards.
