The Tax Audit Unit within the Tax Department performs all Unemployment Insurance Tax Audits as mandated by the U S Department of Labor (DOL), enforced tax collection of unpaid taxes, and investigative enforcement activities prescribed by the North Carolina General Statute Chapter 96, Employment Security Law and the North Carolina Division of Employment Security Rules. The Division of Employment Security is responsible for the administration of the unemployment insurance program in the state of North Carolina. This program is a federal-state partnership, funded by federal and state unemployment taxes, which employers pay on the wages of their employees. Benefits are paid to eligible workers who lose their job through no fault of their own and are able, available, and actively seeking work. To perform complex audits relative to the entity structure, tax compliance history, industry classification and employer size. Tax Auditors within this position perform audits on all contributory employers, all business types, all industry classifications, all employers measured in employee size and all employers from multi-state employers to multi-national employers. This includes all experience rated employers that pay taxes and are legally structured as sole-proprietorships, partnerships, C-Corporations, Subchapter S-Corporations, ESOPs, Estates, Professional Associations, Non-profit entities, LLCs taxed as sole proprietorships, partnerships, corporations and all other legal entity types. Tax Auditors’ other duties include enforced collection of delinquent tax, investigation of underground economy and investigation of blocked claim wage protests, status liability investigations, Assistant Secretary Orders and collection of worthless checks. Tax Auditors work independently in the field conducting interviews with employers, employees, attorneys, accountants, and other designated third parties to determine employer business operations and secure factual information within the audit process. Tax Auditor will request the issuance of a Subpoena Duces Tecum from Regional Tax Manager and Tax Audit Chief for an employer to appear with relevant records not provided to NC DES during an interview, pre-audit interview and subsequent document request(s). The Tax Auditor’s opinion of the audited employer’s compliance and solvency could be used by Regional Tax Manager and Tax Audit Chief during post investigation collection discussions. Tax Auditor is required to audit, for the purpose of rendering an opinion on behalf of NC DES, the required financial records of employers selected for audit. Selected, Random, Management or Converted audits are assigned to Tax Auditors in addition to internal detection referrals from NC Government Data Analytic Center (GDAC) pursuant to North Carolina Senate Bill 15. Tax Auditors collect delinquent taxes (taxes, interest, late filing penalties, late payment penalties, worthless check penalties, docket fees and improper filing penalties), investigate underground economy activity and investigate blocked claim wage protests. Tax Auditors collect delinquent U I Taxes and initiate enforced collection activities which adhere to NCGS Chapter 96 remedies available. Enforced collection activities result in taxes collected, time payment agreements, or Civil Court proceedings. Tax Auditor recommends initiation of Enjoinment proceedings to Regional Tax Manager and Tax Audit Chief. The Tax Auditor serves as a subject matter expert witness on behalf of NC DES during Civil Court proceedings. Tax Auditors assist management in training newly hired Tax Auditors and other personnel. Tax Auditors educate and support employers concerning compliance requirements to NCGS 96 and Employment Security Law. Tax Auditors assist employers, claimants, Regional Tax Managers, Tax Audit Chief, and NC DES in times of emergency with Disaster Unemployment Assistance (DUA) and Pandemic Unemployment Assistance (PUA).
