About The Position

The Office of General Counsel (OGC) at the NYC Department of Health has an opening for one attorney to serve as Deputy Privacy Officer who will be under the direction of the General Counsel, Deputy General Counsel, and the Chief Privacy Officer (CPO) of the NYC Health Department. The Deputy Privacy Officer will be a key member of the Privacy unit within Legal Affairs to provide counsel and support on legal matters related to privacy and data security.

Requirements

• Admission to the New York State Bar
• One year of satisfactory United States legal experience subsequent to admission to any state bar; or Six months of satisfactory service as an Agency Attorney Interne (30086).
• Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
• To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
• To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

• Previous experience using online legal databases such as West Law, CLEAR or Lexis Nexis
• Current working knowledge of Health Department procedures, policies and practices is a plus
• Current experience in or knowledge and interest in Freedom of Information Law requests, Privacy Issues, Day Care and Restaurant Enforcement, responding to subpoenas, and other public health matters is a plus.
• Advanced knowledge of standards, guidelines, and best practices to manage privacy and cybersecurity risk, such as NIST Privacy Framework and NIST Cybersecurity Framework.
• Advanced knowledge of the Health Insurance Portability and Accountability Act (HIPAA).
• Certified Information Privacy Professional accreditation through the International Association of Privacy Professionals (IAAP) is strongly recommended.

Responsibilities

• Assist the CPO in handling the day-to day matters, priorities, and legal assignments for the Privacy Unit.
• Draft, review and negotiate data privacy and security agreements (such as cloud security agreements, end user license agreements, terms of service, privacy policies, and others).
• Draft, review, and negotiate various contracts with vendors procured by the agency.
• Provide support to the CPO to develop and implement policies for data privacy and security.
• Support the CPO with investigations of security incidents and notifications to impacted individuals.
• Provide practical, timely, strategic, and high-quality legal recommendations and counsel to the IT division on data security and cybersecurity.
• Advise agency programs on federal, state, and local data privacy laws and requirements, and recommend practical approaches to address emerging legal and operational issues.
• Deliver data privacy and security trainings to the DOHMH workforce.
• Represent OGC and agency at meetings and working groups involving privacy, data governance, technology, and information management.
• When needed, participate and engage in cross divisional collaborative projects that require legal support.
• Learn and keep informed of federal, state, and local laws and regulations as well as industry standards for data privacy and security.
• Other assignments, as needed, to support the Office of General Counsel.
