About The Position

The Office of General Counsel is seeking to hire a self-motivated, organized and detailed-oriented individual with a license to practice law in Illinois to serve as Deputy General Counsel for the Division of Rehabilitation Services. The Deputy General Counsel serves as the principal legal advisor to the Division of Rehabilitation Services and advises on all legal matters concerning the provision of services to individuals with disabilities. While this position advises on any legal issues concerning provision of services to individuals with disabilities, it will have concentrations in Medicaid law, education law, administrative law, and review of special needs trusts. The Deputy General Counsel provides advice, assistance and consultation to leadership within the Division of Rehabilitation Services and to executive staff within the Department of Human Services. The Deputy General Counsel supervises other attorneys within the Office of General Counsel and regularly liaises with attorneys from the Office of the Governor, non-profit agencies serving individuals with disabilities, private attorneys, and attorneys from other federal, State, and municipal agencies.

Requirements

Requires a law degree from an American Bar Association accredited law school.
Requires possession of a license to practice law in Illinois.
Requires four (4) years progressively responsible professional experience in the practice of law as a licensed attorney.

Four (4) years of professional experience litigating or providing legal advice to clients on matters within the fields of disability, healthcare, or education law.
Four (4) years of professional experience as a licensed attorney providing legal advice to management in a governmental, social services, healthcare, or educational organization.
Four (4) years of professional experience supervising attorneys and assigning legal work.
Four (4) years of professional experience as a licensed attorney drafting, reviewing, and negotiating contracts, data sharing agreements, or other legal agreements.
Four (4) years of professional experience conducting legal research and providing legal advice to clients on interpretation and implementation of Home and Community-Based Medicaid Waivers or federal Medicaid law.
Four (4) years of professional experience as a licensed attorney working with confidential student and health records, including releases of information and statutory protections under the Health Insurance Portability and Accountability Act of 1996, the Mental Health and Developmental Disabilities Confidentiality Act, the Family Educational Rights and Privacy Act, or similar confidentiality laws.

Responsibilities

Serves as Deputy General Counsel providing legal advice and counsel to Department of Human Services programs operated by the Division of Rehabilitation Services, including the Illinois Centers for Rehabilitation and Education, the Illinois School for the Deaf, and the Illinois School for the Visually Impaired.
Serves as a full line supervisor.
Works with external parties to resolve legal matters before involving the Office of the Attorney General.
Analyzes and interprets statutes, regulations, and Home and Community-Based Medicaid Waivers governing the provision of services to individuals with disabilities, including, but not limited to: the Rehabilitation of Persons with Disabilities Act, the Illinois School Code, Faith’s Law, the Illinois Administrative Code, the Americans with Disabilities Act, the Rehabilitation Act, the Social Security Act, the Individuals with Disabilities Education Act, the Illinois Human Rights Act, the Health Insurance Portability and Accountability Act of 1996, the Family Educational Rights and Privacy Act, Title IX of the Education Amendments of 1972, and the Omnibus Budget Reconciliation Act of 1993, the Workforce Innovation and Opportunity Act, 34 C.F.R. Part 361, the Randolph-Sheppard Act, and the Mental Health and Developmental Disabilities Confidentiality Act.
Drafts and reviews a variety of complex legal documents for the Division of Rehabilitation Services, including contracts, intergovernmental agreements, data sharing agreements, and student affiliation agreements.
Assists the General Counsel and Chief Deputy General Counsels in the overall functioning of the Office of the General Counsel within the Department of Human Services.
Performs other duties as required or assigned which are reasonably within the scope of the duties enumerated above.
