About The Position

Delaware's Attorney General, the State's chief law enforcement officer, has a broad responsibility to combat crime, uphold civil rights, safeguard families, fight fraud, and protect consumers in the First State. In meeting this mission, Attorney General Kathy Jennings is supported by teams of talented lawyers and staff in the Criminal, Civil, Family, Fraud and Consumer Protection, and Civil Rights and Public Trust Divisions. Each of the more than 500 staff who work in the Office of the Attorney General are dedicated to serving all Delawareans with integrity and passion. The White Collar Crime Unit (WCCU) is part of the Fraud and Consumer Protection Division and is based in New Castle County. DAGs in WCCU prosecute crimes statewide that involve financial misconduct and such other criminal matters assigned by the Division Director. The WCCU also pursues civil actions under the Delaware False Claims and Reporting Act for fraud committed against the government. The Delaware Department of Justice is looking for a highly motivated and committed deputy attorney general to join the White Collar Crime Unit to fill its “Wage Theft” DAG vacancy. While the successful candidate will work as a member of the WCCU team on the full range of cases handled by the unit, this position will have primary responsibility for leading the Division’s efforts related to labor-related crimes and misconduct. This position may be eligible for telework for up to three day per week.

Requirements

Substantial felony trial experience.
Substantial experience handling document-intensive cases involving financial misconduct.
Demonstrated ability to evaluate criminal cases, to determine resolutions, and to anticipate legal issues.
Admission to the Delaware Bar, or a willingness to sit for the next Delaware Bar Exam, is required.
A strong commitment to working in the public interest.

Nice To Haves

Familiarity with finance, tax, accounting or labor law is helpful, but not a prerequisite.

Responsibilities

Decide what cases should be prosecuted, which should be resolved by trial, and will try the cases that are not otherwise resolved.
Handle criminal matters statewide and travel throughout the state is contemplated.
Lead the Department’s initiative focused on labor-related crimes and misconduct.
Direct the investigation and, when appropriate, prosecution of cases involving worker exploitation and wage theft.
Play an instrumental role in the development of prosecutions brought under the recently enacted statute establishing wage theft as an offense under the Delaware criminal code.
Coordinate with peers in other jurisdictions, participate in training to develop proficiency and, in turn, conduct training for investigators and support personnel engaged in this effort.
Represent the Unit at meetings involving business crime issues, including with federal counterparts.
Meet with referral agencies to address issues in the investigation and prosecution of cases within the Unit’s jurisdiction.
Perform intakes and reviewing cases for prosecution.
Work as part of a team with the other members of the WCCU on the full range of WCCU cases.
Develop a good working relationship with other deputy attorneys general, investigative partners, support staff and court personnel.
