About The Position

This position is funded to begin 10/01/2026. Reporting directly to the Civil Division Chief, this role is responsible for representing the State in a broad range of civil matters. This includes civil litigation for the County (both plaintiff and defense), providing counsel to Elected Officials and department heads, and offering legal representation for the Sheriff’s Office and other law enforcement agencies as needed. The attorney will represent the County in mental health civil commitment cases, juvenile law prosecution, bond forfeiture proceedings, and all civil litigation proceedings. Occasionally, the role involves representing the Department of Family Protective Services in Child Protective Services (CPS) proceedings. A key responsibility includes reviewing responsive information in Public Information Act requests from responsive departments and providing necessary legal redactions. The position also involves preparing information for submission in exhibits to the Attorney General’s Office for rulings. The Public Information Act Assignment specifically involves drafting responses to requestors for all county departments and elected officials regarding Public Information Act requests (PIAs), reviewing and responding to third-party notices related to PIA requests, and providing legal consultation on PIA and Rule 12 requests. The role also requires regular consultation with the Office of the Attorney General (OAG) on complex PIA requests and reviewing OAG rulings.

Requirements

  • Doctor of Jurisprudence from an accredited law school.
  • Five (5) years of experience in a county or district attorney office, city attorney, or other governmental attorney with experience in areas related to the job duties; or six (6) years of civil law experience as an attorney in relevant areas.
  • Working knowledge of Microsoft Office Suite, Adobe Acrobat, LexisNexis, and Westlaw.
  • State Bar of Texas.
  • Valid driver’s license.
  • Texas Crime Information Center (TCIC) certification (Required within six (6) months of employment).
  • Criminal Justice Information Services (CJIS) certification (Required within six (6) months of employment).

Nice To Haves

  • Working knowledge of Odyssey and Digital Evidence management System (DEMS).
  • Prior experience and working knowledge of the Public Information Act and relevant laws.

Responsibilities

  • Represent the State in a broad range of civil matters, including civil litigation for the County (both plaintiff and defense).

  • Provide support and assistance to the Civil Division Chief in performing all duties related to defense representation of the County or County officials in civil litigation, tort claims, civil rights claims/Section 1983 litigation, employment claims, and other civil issues, including discovery, mediations, trials, and appeals.
  • Provide in-depth research briefs on a wide variety of topics pertaining to civil law.
  • Provide legal advice and counsel to county officials on legal inquiries and requests for opinions related to varied areas of law and the official’s duties pursuant to law while counseling on any exposure to liability and litigation.
  • Execute responsibilities for communication with claimants or attorneys representing claimants regarding conclusions.
  • Draft pleadings and response motions to include but not limited to Motions to Quash, Plea to the Jurisdiction, Motions to Transfer, General Answers, and Application for Appointment of Guardian.
  • Provide representation and assistance to the Bail Bond Board.
  • Represent the State in bail bond forfeiture proceedings.
  • Conduct legal research and analysis in preparation for legal briefs, pleadings, and motions to be filed and argued in court regarding litigation pending against the County and/or County officials and employees.
  • Perform contract or document review, or preparation of contracts and other legal documents.
  • Prepare training materials and provide training and counsel to local law enforcement agencies on legal matters pertaining to the investigation and processing of criminal and civil matters.
  • Communicate with outside agencies and county personnel, including department heads, law enforcement, elected officials, county employees, attorneys, and opposing attorneys.
  • Interface with other law enforcement agencies and governmental departments for interagency transfers.
  • Provide back-up duties and responsibilities as needed for all other attorneys within the Civil Division (i.e., Juvenile, Public Information Requests, Mental Health, Civil Litigation, Family Justice Division) and represent county departments, cross trains to basic proficiency in each of these areas.
  • Periodically attend Commissioner’s Court open and executive sessions to offer legal advice and counsel.
  • Attend all meetings and trainings, as required.
  • Perform special duties as assigned.
  • Draft responses to requestors for all county departments and elected officials on request to process Public Information Act requests (PIAs).
  • Review, process and respond to third party notices related to PIA requests.
  • Draft, review and submit third party notices related to PIA requests on behalf of county departments and elected officials on request related to PIAs.
  • Respond to or provide advice on Rule 12 and Public Information Act (PIA) requests and, when necessary, prepare requests for rulings with legal briefs for submission to the Office of the Attorney General (OAG).
  • Provide legal consultation regularly to elected officials and department heads on request for Public Information Act requests and/or related complaints.
  • Provide legal consultation regularly to elected officials and department heads for Rule 12 requests and/or related complaints.
  • Consult regularly with the OAG regarding specialized questions on complex PIA requests.
  • Conduct legal research and analysis in preparation for legal opinions to County officials, briefs in litigation, or OAG Opinion requests.
  • Review OAG rulings on brief submissions for PIA requests and provide redactions necessary on responsive information per OAG rulings.
  • Review all responsive information in PIA requests from responsive departments and provide legal redactions as necessary; prepare information for submission in exhibits for OAG ruling requests.
  • Regularly organize and filter various documents of responsive information and provide necessary redactions for public information requested.
  • Prepare and present trainings on cost-estimates and how to properly calculate the labor hours, overhead costs, copies, scanned documents, and inspection costs under the PIA.
  • Perform special duties as assigned within the civil division.
