About The Position

The Enforcement Agent performs investigative work for Child Support Enforcement purposes. The agent is responsible for the Enforcement of new paternity and support orders. Agents have control and responsibility for the financial management and accounting of these support orders. In monitoring cases, the agent investigates what action to take when a court order needs modification to meet current guidelines. Activities that must have the sanction of an Attorney are reviewed by the IV –D Attorney but the Agent is responsible for most of the actual preparation, investigation and negotiation required in each case. Considerable independent judgment is exercised in applying appropriate rules, regulations and laws to specific cases.

Requirements

  • Current Child Support experience preferred.
  • Ability to monitor terms of court orders (monetary payments, medical coverage requirements, etc.) through reviewing NC’s automated Child Support system - ACTS.
  • Ability to identify cases in delinquency status and determine appropriate enforcement actions.
  • Ability to administratively withhold child support from earned and unearned income, including establishing, increasing, and transferring withholding.
  • Ability to update information in ACTS to ensure legal documents are properly generated, review and correct documents, schedule hearings, and enter service process and hearing information into ACTS.
  • Ability to notify absent parents and licensing boards regarding license suspension or revocation.
  • Ability to verify through DMV willful contempt and 90-day delinquency for driver's license and vehicle registration actions.
  • Ability to update the Department of Motor Vehicle’s Mainframe system and ACTS and ensure appropriate court orders are executed.
  • Ability to ensure accuracy of arrears provided to credit bureaus and State and Federal agencies.
  • Ability to verify arrears, case information, and events prior to hearings for appeals.
  • Ability to attend hearings and provide legal documentation and testimony.
  • Ability to verify medical insurance coverage for children.
  • Ability to assess orders, insurance availability, and administrator to determine notification of employer or issuance of Show Cause for Medical Contempt.
  • Ability to determine if obtaining a lien is appropriate and coordinate with the sheriff’s office and other involved agencies.
  • Ability to understand provisions for requiring bond or security to monitor and interpret affected court orders.
  • Ability to consider enforcement procedures with respect to other laws if the absent parent is in bankruptcy.
  • Ability to verify location and employer of the absent parent using all available resources.
  • Ability to analyze information and determine appropriate steps.
  • Ability to assess cases and make appropriate referrals to State and Federal locate resources.
  • Ability to prepare cases for modification, including court fact sheets, issuance of subpoenas, and other evidence.
  • Ability to review court cases with IV-D Attorney prior to court dates.
  • Ability to assist IV-D Attorney in presentation of cases in the courtroom.
  • Ability to testify in court when required.
  • Ability to negotiate with the non-custodial parent and/or their attorney.
  • Ability to make accurate notes of orders and information needed from court docket maintenance.
  • Ability to remain conscious of client’s requests, county/state interest and priorities.
  • Ability to control and be responsible for the financial management and accounting of child support orders.
  • Ability to enter financial terms of initial court orders and modifications into ACTS.
  • Ability to analyze, reconcile and review financial history in cases.
  • Ability to certify arrears for court, obligors, obligees or other agencies upon request.
  • Ability to monitor and reconcile accounts and subaccounts in ACTS to ensure proper distribution.
  • Ability to assess the Undistributed Receipts Report and initiate prompt actions.
  • Ability to document ACTS regarding all activities taken on a case.
  • Ability to update ACTS with any changes.
  • Ability to investigate information from ACTS interfaces for correctness, analyze it, and determine appropriate steps.
  • Ability to communicate routinely with clients, non-custodial parents and employers about the child support process.
  • Ability to explain the distribution of collections to clientele.
  • Ability to work closely with Sheriff’s Offices for service of process.
  • Ability to work closely with Clerk of Court personnel.
  • Excellent communication skills to listen and converse with people of diverse backgrounds.
  • Ability to maintain a professional relationship with local resources.
  • Courtesy, tact and firmness required in dealing with clients, non-custodial parents, Offices of Clerk of Court, Magistrates, Sheriffs, Judges and other entities.
  • Knowledge and legal expertise to take appropriate actions for amendment of court orders.
  • Ability to make appropriate verifications and gather updated information that would affect child support guideline worksheets and other provisions of a court order.
  • Ability to settle matters by consent of all parties or initiate legal action for a court hearing.
  • Ability to generate appropriate legal pleadings, gather evidence and subpoena witnesses.
  • Highest degree of accuracy required in legal actions, court related duties and financial case management.
  • In-depth understanding of the complex ACTS system.
  • Ability to skillfully control interviews and diffuse potential volatile situations.
  • Ability to refer clients to the Court System and/or the Eligibility Unit if they want to claim ‘Good Cause’ for not cooperating.
  • Ability to process cases within timeframes and keep up with changing regulations and the ACTS system.
  • Thorough knowledge of the Child Support Enforcement Program and applicable legal procedures.
  • Considerable ability to interview clients, non-custodial parents and related sources and to investigate cases.
  • Considerable ability to organize, analyze and summarize case information.
  • Intermediate math skills.
  • Ability to establish and maintain effective working relationships with clients, non-custodial parents, location sources, offices of the Clerks of Court, Judges, private attorneys, Sheriffs and other court officials.
  • Graduation from high school and three years of experience in eligibility, investigative, judiciary, or legal work; OR an associate degree in business administration, human resources, law enforcement or closely related degree and two years of experience in eligibility, investigative, judiciary, or legal work; OR a four-year degree and six months experience in eligibility, investigative, judiciary, or legal work; or an equivalent combination of education and experience.

Responsibilities

  • Enforce and modify court orders.
  • Monitor terms of court orders (monetary payments, medical coverage requirements, etc.) through reviewing NC’s automated Child Support system - ACTS.
  • Identify cases in delinquency status and determine appropriate enforcement actions, considering provisions of court orders, payment history, locate information, program requirements, arrearage amounts, earned and unearned income, real or personal property holdings, and pending insurance settlements.
  • Implement enforcement actions such as Income Withholding, Show Cause for Contempt Hearings, Revocation of Occupational/Professional/Business/Wildlife Licenses, Revocation/Suspension/Blockage of Driver’s Licenses and Vehicle Registrations, Notice to Credit Bureaus and Interception of Federal and State Income Tax Refunds, verification of Medical Insurance Coverage for Children, Property Liens and Insurance Settlements Liens, requiring Bond or Security, and enforcement during bankruptcy.
  • Verify the location and employer of the absent parent using all available resources and analyze information from ACTS interfaces.
  • Prepare cases for court modification, including court fact sheets, issuance of subpoenas, and other evidence.
  • Review court cases with IV-D Attorney prior to court dates and assist in courtroom presentations.
  • Testify in court when required.
  • Negotiate with non-custodial parents and/or their attorneys.
  • Maintain accurate notes of orders and information from court dockets.
  • Control and manage the financial management and accounting of child support orders.
  • Enter financial terms of court orders and modifications into ACTS.

  • Communicate routinely with clients, non-custodial parents, and employers about the child support process.
  • Explain the distribution of collections to clientele.
  • Work closely with Sheriff’s Offices for service of process and Clerk of Court personnel.
  • Maintain professional relationships with local resources such as employers, Postal Services, Employment Security Commission, Social Security Administration, and Probation/Parole.
  • Add additional children to existing court orders, making appropriate verifications and gathering updated information.
  • Initiate legal action for a court hearing if matters cannot be settled by consent.
  • Generate appropriate legal pleadings, gather evidence, and subpoena witnesses.
  • Work in emergency shelters and/or perform related disaster tasks.
  • Perform other reasonable tasks requested by the supervisor.
