About The Position

To ensure proper action is taken to follow the current bankruptcy laws to protect the member and the Credit Union. This position is responsible for the processing of incoming federal bankruptcy pleadings, including but not limited to bankruptcy filing notifications, discharge orders, and dismissal orders. This position is also responsible for explaining the actions taken by the Credit Union (e.g. account maintenance, legal action) to members, branches, Credit Union departments, bankruptcy trustees, and to the member’s and the Credit Union’s legal representatives. Under direction of management, this position oversees managing an assigned queue/portfolio of bankruptcy accounts (Chapter 7, Chapter 11, Chapter 13, and/or BK Mortgage) in accordance with bankruptcy law.

Requirements

5 years professional experience working in a bankruptcy position, law firm specializing in creditor representation, or Trustee’s office with experience in bankruptcy case management.
Bachelor’s Degree from an accredited institution in business, finance, related field. Education will be verified. OR 4 additional combined years of experience in bankruptcy or in a progressive financial/related setting.
Advanced skills with Microsoft Office Suite including Outlook, Word, PowerPoint, and Excel
Advanced knowledge of PACER, CM/ECF filing, and Trustee websites (13network and/or NDC)
Demonstrated ability to clearly express ideas, methodology, results and recommendations verbally, in writing and through insightful reports and graphic illustrations
Demonstrated ability to document outcomes and present information in a manner appropriate for key stakeholders and all levels of the organization.
Ability to work both autonomously and collaboratively in a fast-paced environment.
Self-starter with strong organizing and time management skills and the ability to work productively and efficiently in a fast-paced environment with multiple projects and timelines.
Adaptive to change, responds positively to altered circumstances or conditions.
Possess a desire and willingness to learn and continually update knowledge base on financial concepts, strategies, systems etc.

Nice To Haves

Additional coursework in banking and credit, collection law are preferred.
Demonstrated experience with Symitar preferred.

Responsibilities

Reviews all incoming federal bankruptcy court documents and examines filed pleadings to determine appropriate action.
Processes federal bankruptcy court documents, such as bankruptcy filing notifications, discharge orders, and dismissals.
Conducts examination of Chapter 7 Statement of Intention and/or Chapter 13 Plan.
Responsible for preparing and filing Notices of Payment Change, Post-Petition Fee Notices, and Responses to Notice of Final Cure within required deadlines.
Monitors for compliance with the member’s Chapter 7 Statement of Intention or the Chapter 13 Plan by following up on assigned queue.
Provides queue reviews to management on a monthly basis.
Works directly with attorneys to ensure proper steps are taken; refers routine-to-complex legal action to Credit Union’s attorney networks, including Motions for Relief from the Automatic Stay, Objections to Confirmation, Objections to Discharge, and various responses to motions.
Works with corporate counsel and outside counsel regarding lien perfection, trustee preference, and lien avoidance issues.
Recommends accounts for repossession, and where necessary, other collection action.
Answers incoming calls from members, member’s legal representatives, the Credit Union’s legal representatives, and bankruptcy trustees; responsible for accurately answering questions and resolving routine issues related to these processes.
Attends 341 Hearings as needed.
Ensures that daily processes are in compliance with any changing bankruptcy laws and regulations.
Incorporates MACU values and philosophy while fulfilling responsibilities as a representative of the Asset Management department and the Credit Union.
