About The Position

The Montana Department of Corrections (DOC) is seeking an Attorney to serve a vital role in carrying out the department's mission. This position, located in the Director's Office in Helena, MT, offers the opportunity to engage with a wide array of policy and legal topics impacting the department's day-to-day operations, including constitutional, labor, tort, contract, and administrative law. The Director's Office provides critical support to the department's executive team through various functions, and this role is at the forefront of managing change on behalf of Montana citizens.

Requirements

  • Juris Doctorate degree from an accredited law school
  • Must be admitted to practice law in Montana and federal district courts

Nice To Haves

  • Two years of legal work preferred
  • Knowledge of correctional policies, programming, and rules
  • Knowledge of constitutional, administrative, public safety, healthcare, contracts, employment, data privacy, and Montana public records laws
  • Knowledge of courtroom practices and procedures
  • Ability to adapt and operate in a dynamic and technical legal environment
  • Ability to organize and prioritize work to meet deadlines with limited oversight
  • Ability to exercise sound legal judgment in the analysis, review, and handling of assigned work and cases from start to finish
  • Ability to communicate orally and in writing in a clear and concise manner

Responsibilities

  • Draft and/or amend administrative policies and procedures
  • Draft policies and procedures, rules, pleadings, motions, briefs, memorandums, and opinions
  • Conduct discovery
  • Prepare witnesses
  • Initiate and conduct settlement negotiations
  • Present cases in state and federal court
  • Present in front of large groups and over electronic platforms to deliver legal presentations and trainings
  • Respond to work collaboratively with others, including outside counsel, county attorneys, defense attorneys, other agencies, and judges concerning the application and interpretation of statutes, rules, regulations, policies and procedures
