About The Position

The Office of the General Counsel at San Francisco Bay Area Rapid Transit (BART) is seeking a skilled Attorney II or Attorney III to join its legal team. This role offers the opportunity to work on a wide range of legal matters supporting a major public transit agency. The position involves providing practical, strategic legal advice across multiple subject areas, with a primary focus on labor and employment matters, public contracting, and regulatory compliance, while also contributing to broader agency initiatives. Regular and predictable, in-person attendance is an essential function of this role. Key responsibilities include representing the District in labor arbitrations and advising Labor Relations staff; representing the District in disciplinary hearings and advising Human Resources staff; providing counsel on public contracting and procurement issues; reviewing and advising on California Public Records Act requests; and appearing in court proceedings, including Pitchess motions and restraining orders. The role may also involve work in areas such as real estate, land use, environmental law, energy and utilities, intellectual property, constitutional law, litigation, and inter-agency agreements. The ideal candidate is a strong legal writer and advocate who can manage diverse assignments and provide clear, practical advice to internal clients. Experience in public agency law, labor relations, employment law, or administrative proceedings is highly desirable. Candidates should demonstrate sound judgment, the ability to handle sensitive matters, and a collaborative approach to working with a wide range of stakeholders.

Requirements

  • Possession of a bachelor’s degree from an accredited college or university.
  • A Juris Doctorate from an accredited law school is required.
  • Attorney II: Three (3) years of (full-time) professional verifiable experience as an attorney engaged in the practice of civil law or closely related experience.
  • Attorney III: The equivalent of seven (7) years of full-time professional verifiable experience as an attorney engaged in the practice of civil law or closely related experience.
  • Current active membership in the California State Bar
  • Experience in labor law such as representing management in labor arbitrations, drafting and interpreting collective bargaining agreements and/or negotiating with labor unions.
  • Background or experience in advising management on employment law matters such as employee misconduct and discipline, discrimination, harassment, retaliation, whistleblower claims, disability accommodations, leave requests, workplace violence, and/or investigations.
  • Familiarity and/or experience with laws applicable to public agencies, such as the California Public Records Act, the Brown Act, the Political Reform Act, Government Code Section 1090 and/or CA Evidence Code Sections 1043-1047, are preferred.

Responsibilities

  • Representing the District in labor arbitrations and advising Labor Relations staff.
  • Representing the District in disciplinary hearings and advising Human Resources staff.
  • Providing counsel on public contracting and procurement issues.
  • Reviewing and advising on California Public Records Act requests.
  • Appearing in court proceedings, including Pitchess motions and restraining orders.
  • Work in areas such as real estate, land use, environmental law, energy and utilities, intellectual property, constitutional law, litigation, and inter-agency agreements.
  • Reviews, prepares, and assists in the negotiation of contracts and agreements, including competitive bid construction and procurement contracts, professional services agreements, joint powers and other public agency agreements.
  • Works with various District departments on development and implementation of various construction projects, interagency agreements, equipment purchases and professional service agreements.
  • Confers with and advises officers and employees of the District on legal questions pertaining to their respective duties, powers, functions and obligations.
  • Advises management on a wide variety of labor and employment matters; provides legal support and advice for collective bargaining including drafting, reviewing and interpreting contract language; represents the District in in-person labor arbitrations.
  • Prepares and drafts various types of legal correspondence including letters, memos, briefs, pleadings, and opinions regarding settlements and negotiations.
  • Conducts legal research; reviews claims and lawsuits filed against the District; coordinates investigations; facilitates negotiation of claims; drafts settlement agreements.
  • Represents the District in and/or assists Senior Attorneys in preparation for in-person court appearances including hearings and trials; arranges and attends depositions.
  • Reviews new and existing statutes and regulations that may affect the District; advises staff on the impact of new or existing legislation; drafts proposed legislation.
  • Prioritizes workload; maintains a calendar of activities, appointments, legal engagements and meetings.
  • Attends and participates in in-person special group meetings; stays abreast of new trends and innovations in the legal field.
  • Responds to California Public Records Act requests.
  • Receives and responds to written and verbal inquiries; prepares answers to certain public inquiries.
  • Assesses and evaluates legal claims against the District and advising senior management and the Board of Directors on their resolution.
  • Responds to third-party subpoenas and California Public Records Act requests.
  • Provides advice to reduce or mitigate legal risks.
  • Reviews and negotiates complex and unique legal issues.
  • Facilitates District’s Industrial Disability Retirement appeal status with State.
  • Represents the District in higher-level, in-person labor arbitrations.
