About The Position
This Attorney I position is within the North Carolina Department of Justice/Attorney General’s Office (DOJ), Condemnation Section, which represents the North Carolina Department of Transportation (DOT) in eminent domain/condemnation actions. The primary purpose of this Attorney I position is to represent DOT in condemnation actions filed by DOT in Superior court, in which the parties are entitled to a jury trial. Once the action is filed, the attorney, with appropriate supervision, will represent DOT in all phases of the litigation, including discovery, mediation, pre-trial motions and ultimately at trial. The cases handled by this position will typically involve a parcel of land initially valued at less than $100,000 that DOT has acquired from a larger tract of land, or, an entire tract of land that DOT as acquired, referred to as a “total take.” The attorney will also assist the senior attorneys in the Condemnation Section with more complex cases, including cases involving permanent utility easements and other easements, homeowner associations, and hearings to determine issues other than damages, pursuant to N.C. Gen. Stat. § 136-108. The position will also perform other duties as assigned by the Attorney Manager of the Condemnation Section and other senior attorneys within the Condemnation Section.
Requirements
- Licensed to practice law by the North Carolina State Bar.

Responsibilities
