About The Position

This Attorney-Adviser position supports the Defense Health Agency (DHA) Office of General Counsel in Falls Church, Virginia. It is in the Excepted Service and does not confer competitive status. The attorney handles complex legal matters involving the TRICARE program, the Military Health System, DHA contracting and acquisition, and healthcare fraud and abuse. The position requires three or more years of professional legal experience acquired after admission to the Bar for the NH-04 level.

Requirements

Graduate from an American Bar Association-accredited law school with a first professional law degree (LL.B. or J.D.).
Be an active member in good standing of the Bar of a U.S. state, the District of Columbia, a U.S. territory, or a U.S. commonwealth; bar-status documentation must be dated within three months of application submission.
For the NH-04 level, have at least three years of professional legal experience acquired after admission to the Bar, commensurate with the position’s duties and responsibilities.
Be able to obtain and maintain eligibility for a Secret security clearance or access throughout employment.
Submit a Public Financial Disclosure Report (OGE 278) or Confidential Financial Disclosure Report (OGE 450) upon entry and annually thereafter.
If currently employed as a federal attorney, meet the applicable time-in-grade requirement: 52 weeks at the next lower grade within 30 days of the announcement closing date, or prior service at the same or higher grade; time-in-grade may be waived at management’s discretion.
Provide proof of U.S. citizenship.
Male applicants born after December 31, 1959, must complete a Pre-Employment Certification Statement for Selective Service Registration.
Demonstrate skill in identifying contracting and acquisition legal issues.
Demonstrate ability to prepare litigation reports and briefings.
Demonstrate oral and written advocacy skills.
Demonstrate ability to manage a heavy caseload of clients with complex legal needs effectively, professionally, and ethically.
If relying on foreign education, provide evidence that it has been evaluated and deemed equivalent to an accredited U.S. education program, or that full course credit was granted by an accredited U.S. college or university.

Nice To Haves

Veteran’s preference eligibility is considered a positive factor for attorney hiring; applicants claiming preference must provide supporting documentation, and applicants claiming 10-point preference must also submit SF 15 and required supporting documents.
Military spouse preference may be claimed.

Responsibilities

Manage fraud cases by determining and coordinating appropriate civil, criminal, and administrative remedies.
Coordinate with government partners, including the Department of Justice and criminal investigators; provide litigation support and official agency legal analysis, including on settlements.
Manage the suspension and debarment process, including analyzing referrals, preparing administrative records, and drafting decisions for the Suspension and Debarment Official.
Support the Department of Justice, the DHA Office of Inspector General, and other stakeholders on TRICARE-related healthcare fraud and abuse matters.
Represent the government in adversarial proceedings and hearings, including Government Accountability Office bid protests and Armed Services Board of Contract Appeals proceedings.
Support the Department of Justice in civil litigation affecting the Military Health System, DHA, and the TRICARE program.
Review complex contractual documents and provisions for legal sufficiency and compliance with applicable laws, regulations, and policy.
Formulate the government’s legal position on claims, disputes, and appeals.
Perform other duties as assigned.
