About The Position

The Georgia Department of Community Health (DCH) is seeking a qualified candidate for the position of Attorney 4 within the Healthcare Facility Regulation Division (HFRD) Legal Services Unit. This role provides legal support to HFRD and involves extensive statewide travel, potentially including overnight stays. It is a hybrid position requiring both in-office and remote work, with the possibility of changes to the in-office schedule based on business needs. The Attorney 4 will operate under limited supervision, offering oversight, analysis, and recommendations on legal and policy matters within the agency's scope. This position requires advanced legal judgment, interpretation, and problem-solving skills. The Attorney 4 may also serve as a lead worker or provide supervision and guidance to support staff.

Requirements

  • Juris Doctorate from an accredited college or university AND license to practice law in the State of Georgia OR eligibility to sit for the next Georgia Bar examination followed by Georgia Bar exam passage and licensure to practice law in the State of Georgia within one (1) year of hiring OR reciprocity
  • Three years of relevant legal experience OR Three years of experience required at the lower-level Attorney 3 (LEP022)
  • Possession of a valid driver's license, which would enable the applicant to drive in Georgia, and use of a car at work, are required

Nice To Haves

  • At least five (5) years of experience practicing as an attorney performing comparable or related duties
  • Prior supervisory or leadership experience overseeing staff or legal/operational functions

Responsibilities

  • Operates under limited supervision to provide oversight, analysis, and recommendations on legal matters within the agency’s authority and scope
  • Manages complex legal and policy issues requiring advanced legal judgment and interpretation
  • May serve as a lead worker and/or provide supervision to support staff
  • Represents the agency in litigation involving adverse actions against facilities and certified nursing aides
  • Assists in determining and ensuring compliance with applicable federal and state laws, regulations, and agency rules
  • Conducts legal, policy, and risk management research and analysis, and develops legally sound recommendations and responses
  • Reviews and responds to inquiries from legislators, advocates, consumers, family members, and other stakeholders
  • Coordinates the development and revision of agency rules, including research into best practices and regulatory standards
  • Prepares draft rules in collaboration with internal subject matter experts
  • Facilitates informal rules advisory groups and prepares required public rule-making documentation
  • Serves as facilitator for informal dispute resolution meetings and other assigned meetings
  • Oversees responses to Open Records Requests, including document production and compliance with applicable laws
  • Performs document review and redaction as needed, and coordinates referrals of federal records requests to the Centers for Medicare & Medicaid Services (CMS), as appropriate
  • Reviews and analyzes pending legislation affecting the agency and its programs
  • Performs other related duties as assigned
