About The Position

Marvell is seeking a highly skilled and experienced attorney specializing in Intellectual Property (IP) to join our dynamic legal team. You will play a pivotal role in managing portions of Marvell's IP portfolio, providing strategic guidance on IP matters, and supporting our business objectives related to patents, trademarks, copyrights, trade secrets, and open source. This role involves developing and implementing strategies for the creation, protection, and enforcement of Marvell's patent portfolio and other IP assets, working closely with R&D, engineering, product management, and business development. You will also advise business units on IP-related legal issues, conduct IP audits, and provide legal counsel on open source software usage, licensing, and compliance, including SBOM management and analysis of source code for licensing implications. Additionally, you will support efforts to build and iterate on internal Generative AI and open source policies.

Requirements

  • Juris Doctor (JD) degree from an accredited law school.
  • Active membership in good standing with the California, Texas, or Massachusetts State Bar preferred; at a minimum, you must be qualified for and quickly able to obtain Registered In-House Counsel status in California, Texas, or Massachusetts (depending on location)
  • 10+ years of experience practicing law, with a focus on patents and other intellectual property, preferably in a technology-driven industry
  • Open source software experience required and familiarity with open source scanning tools (e.g., FOSSA, Flexera, Black Duck, SPDX)
  • Prior experience with a semiconductor, computer, software, or technology company strongly preferred
  • Strong background in patent law, including patent prosecution and portfolio management
  • Experience with trademark, copyright, and trade secret matters is a plus
  • Proven track record of providing strategic counsel to senior management and business leaders on complex IP issues
  • Excellent communication and interpersonal skills, with the ability to effectively collaborate with internal and external stakeholders
  • Demonstrated ability to thrive in a fast-paced, dynamic environment and manage multiple priorities simultaneously

Responsibilities

  • Develop and implement strategies for the creation, protection, and enforcement of Marvell's patent portfolio and other IP assets across a set of product and technology areas
  • Work closely and collaborate with cross-functional teams, including R&D, engineering, product management, and business development, to align IP strategies with business goals
  • Manage assigned portions of the company's patent portfolio, including patent prosecution, maintenance, and enforcement
  • Support the IP legal team in refining and improving the company’s patent processes
  • Advise business units on IP-related legal issues, including freedom-to-operate analyses, IP licensing, and technology transactions
  • Conduct IP audits and assessments to identify risks and opportunities for IP protection and monetization
  • Stay abreast of developments in IP law and industry trends, providing proactive guidance to mitigate risks and maximize opportunities
  • Support the IP legal team in advising company leadership on strategic IP-related issues
  • Provide legal counsel on open source software usage, licensing, and compliance, including SBOM (Software Bill of Materials) management
  • Work with open source scanning tools to identify and assess licensing risks
  • Interpret and analyze source code to evaluate licensing implications and potential IP issues
  • Advise on open source licenses and their implications for proprietary and open source software integration
  • Support cross-functional efforts to build and iterate on internal Generative AI and open source policies to comply with enacted laws and industry best practices
