About The Position

An Assistant District Attorney in the Appellate Division represents the State of Texas in the Court of Criminal Appeals, the Texas Supreme Court, the Court of Appeals for the First and Fourteenth District, and the various Harris County trial courts. Assistant District Attorneys also provide support to trial prosecutors through research and assistance with their trial court motions and responses in complex litigation.

Requirements

  • A Juris Doctorate degree
  • A current license to practice law with the State Bar of Texas
  • Excellent research and persuasive writing abilities
  • Subject to a criminal history check. Only relevant convictions will be considered and, even when considered, may not automatically disqualify the candidate.

  • Previous appellate or post-conviction writ experience

Responsibilities

  • Preparing appellate briefs, motions for rehearing, and petitions for discretionary review.
  • Handling petitions for writs of mandamus, prohibition, certiorari, and responses to such petitions.
  • Presenting oral arguments in the appellate courts including the First Court of Appeals, the Fourteenth Court of Appeals, the Texas Court of Criminal Appeals, and the Texas Supreme Court.
  • Preparing motions related to direct appeals in the trial and appellate courts.
  • Investigating and responding to pre-trial applications of writs of habeas corpus, including preparing answers and findings of fact and conclusions of law.
  • Providing legal research assistance to trial prosecutors and occasional argument on legal issues in the Harris County criminal trial courts.
