About The Position

The Assistant Compliance and Privacy Manager will assist in overseeing key compliance risk areas including general compliance, fraud, waste and abuse, patient and employee confidentiality, organizational privacy, information governance, data risk classification, accountable care organization compliance, Medicare C & D/Medicare Advantage compliance, Federal healthcare program compliance, and vendor management-related compliance issues. The role supports the Director of Corporate Compliance and Senior Compliance and Privacy Manager in implementing policies and procedures, conducting training, and performing investigations. This position involves assisting in compliance program effectiveness reviews, maintaining reporting systems, coordinating internal audits, and monitoring HIPAA/Patient Privacy compliance. The Assistant Manager will review the effectiveness of the Atlantic Health Compliance and Ethics Program, follow up on reported incidents, conduct investigations, and prepare reports. Responsibilities include assessing and updating organizational policies, evaluating potential billing, Stark, Anti-kickback, and patient privacy risks, and collaborating with management to implement solutions. The role also involves managing and investigating compliance questions and complaints, performing data analytics for compliance reporting, developing communication and training programs, and coordinating HIPAA Security compliance activities. Additionally, the Assistant Manager will investigate HIPAA-related complaints, draft responses to regulatory inquiries, review business associate agreements, and draft/review FCPA and OFAC contractual provisions. The position includes conducting risk assessments and audits, providing compliance and privacy training, preparing presentations, and drafting compliance and HIPAA-related policies and procedures. Assistance with conflict-of-interest reviews and recommendations for enhancing internal controls based on regulatory guidance are also key functions.

Requirements

  • Assist in updating or developing new policies.

  • Collaborate with other managers within the organization to work with management to implement solutions to eliminate potential risks.

  • Develop organizational wide compliance communication plan, communications, and training programs.

  • Draft responses to HIPAA-related regulatory inquiries.

  • Review applicable regulations, relevant case law, and regulatory oversight agency guidance and enforcement decisions.
  • Make recommendations to enhance current internal controls, as necessary.

  • Assist in overseeing vendor management-related compliance issues.
  • Support the Director of Corporate Compliance and Senior Compliance and Privacy Manager to ensure implementation of appropriate policies and procedures.
  • Support compliance training.
  • Conduct investigations.
  • Assist in the conduct of compliance program effectiveness reviews based on the seven elements of an effective compliance program.
  • Maintain a system of reporting and ensure the integrity of all compliance investigations.
  • In consultation with the Director of Compliance or the Senior Compliance and Privacy Manager, direct and coordinate internal audits, and monitor HIPAA/Patient Privacy compliance.
  • Review the posture of the Atlantic Health Compliance and Ethics Program with regard to its effectiveness to promote, prevent, detect, and resolve instances of improper conduct.
  • Follow up on reported incidents of non-compliance.
  • Conduct and/or coordinate internal investigations.
  • Prepare reports on incidents and investigation findings.
  • Assess compliance of the organization's policies and assist in updating or developing new policies.
  • Assist in evaluating areas of potential billing, Stark, Anti-kickback compliance or patient privacy risk.
