About The Position

This position serves as an Assistant City Attorney in the Criminal Division, functioning as a prosecutor. The primary responsibility is the prosecution of misdemeanor cases and municipal code violations in the Prescott City Court. The role also involves assisting the City Attorney with civil matters as assigned. Key duties include performing pre-trial work, managing discovery, conducting interviews, preparing motions, interacting with victims, and participating in court proceedings, hearings, mediation, and trials. The position requires drafting legal documents, researching and applying laws, working on appeals, and providing legal opinions on matters affecting the City's interests. Maintaining current knowledge of legal trends and case law relevant to municipal government is essential. The role involves organizing and applying legal principles to complex problems and monitoring information to ensure legal compliance.

Requirements

  • Juris Doctorate degree from law school accredited by the American Bar Association.
  • Hold active membership, in good standing, with the Arizona State Bar Association.
  • Knowledge of municipal law, regulations, and guidelines.
  • Knowledge of applicable state and federal law.
  • Knowledge of Arizona criminal and civil legal procedures, judicial procedures, and rules of evidence.
  • Knowledge of methods of legal research.
  • Skill in analyzing, evaluating, and organizing facts, evidence, and precedents in difficult and complex cases.
  • Skill in presenting material in a clear, concise, and logical form for oral and written presentations, briefs, or opinions.
  • Skill in communicating, both verbally and in writing.
  • Skill in negotiating effectively and persuasively in both oral and written communications.
  • Skill in using applicable computer software.
  • Ability to draft documents relevant to legal matters.
  • Ability to respond quickly and efficiently to various types of cases assigned.
  • Successful candidate will receive a post-offer, pre-employment background screening to include: Drug screening, Motor vehicle records check, Criminal background screening.

Responsibilities

  • Performs the duties of the Assistant City Attorney in the Criminal Division as a prosecutor.
  • Resolves misdemeanor prosecutions and municipal code violations.
  • Performs pre-trial work and discovery; conducts officer and defense interviews; prepares motions; and contacts victims.
  • Prepares and participates in court proceedings, hearings, mediation, and trials; arranges for and attends depositions.
  • Prepares and drafts letters, memos, and pleadings regarding litigation, settlements, plea bargains, and negotiations.
  • Researches, interprets, and applies laws.
  • Works on appeals.
  • Renders oral and written legal opinions on matters affecting the City's legal interests.
  • Maintains current knowledge of legal trends and current case law relevant to municipal government.
  • Organizes, interprets, and applies legal principles and knowledge to complex legal problems.
  • Observes information and conditions affecting the City's legal interests to help determine compliance with the law.
  • Performs other duties as assigned.
