About The Position

This position represents the State of Florida in all criminal appeals filed with the District Court of Appeal and the Florida Supreme Court. It also involves representing the appropriate state official in habeas corpus proceedings filed by state prisoners in federal courts and handling extraordinary litigation in both state and federal courts. Additional duties may include civil litigation, special projects, post-conviction litigation, and opinions as assigned by the Bureau Chief.

Requirements

• Admission to the Florida Bar.
• Two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.
• Required legal experience must be from the practice of law in a state or territory of the United States.
• Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar, provided that the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment.
• Degree of Bachelor of Laws or Juris Doctor from an accredited law school.
• Complete and accurate application profile including dates of service, reason for leaving, and explanation of any gaps in employment.
• All employment and/or detailed information about work experience must be listed on the application (including military service, self-employment, job-related volunteer work, internships, etc.).
• Responses to pre-qualifying questions must be verifiable by skills and/or experience stated on the employment application and/or resume.

Responsibilities

• Supervise the timely filing of necessary pleadings and documents for the record on appeal.
• Review assignments of error.
• Research and prepare briefs setting forth the State of Florida's contentions and positions on appeal issues.
• Conduct oral arguments in criminal appeals.
• Handle all other responsibilities associated with prosecuting a criminal appeal.
• Represent the appropriate state official in federal habeas corpus proceedings filed by state prisoners.
• Respond to prisoner claims of federal constitutional rights violations.
• Review all state proceedings resulting in the conviction being questioned.
• Supervise and prepare necessary pleadings and responses in habeas corpus proceedings.
• Handle all hearings and prepare post-trial proceedings for habeas corpus cases.
• Handle appeals from habeas corpus proceedings to the United States Court of Appeals for the Eleventh Circuit and the United States Supreme Court.
• Handle extraordinary litigation in state and federal courts.
• Handle any other special assignments or duties assigned by the Bureau Chief, including civil litigation, special projects, post-conviction litigation, and opinions.
