About The Position

The New York City Police Department (NYPD) aims to enhance the quality of life in New York City through law enforcement, peacekeeping, and order maintenance in partnership with the community. The Professional Standards Division supports this mission by developing and implementing compliance mechanisms, conducting objective evaluations to reduce risk and improve operations, and devising corrective solutions. This division ensures compliance with departmental policies, laws, and external oversight, assesses training effectiveness, and conducts independent evaluations. It also partners with the Training Bureau and Legal Matters to implement recommendations from oversight bodies, including developing training programs. This specific role, Agency Attorney III, will report to the Executive Director of Compliance and Development within the Professional Standards Division. The position involves performing legal research on critical criminal law and procedure topics, drafting legal memoranda, advising leadership on legal changes, and communicating with other NYPD bureaus on compliance issues. The attorney will also review documents and Body Worn Camera (BWC) video footage, train division personnel on legal matters, recommend policy improvements, provide guidance on legal issues affecting the Early Intervention Program, and assist in data gathering for compliance meetings.

Requirements

  • Admission to the New York State Bar
  • One year of satisfactory United States legal experience subsequent to admission to any state bar
  • Must remain Members of the New York State Bar in good standing for the duration of this employment.
  • To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
  • To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Responsibilities

  • Conduct legal research on critical criminal law and procedure topics such as car stops and search and seizure law
  • Draft memorandum of law to address legal questions related to Investigative Encounters
  • Advise command leadership on changes to relevant criminal laws and emerging trends
  • Communicate and coordinate with the NYPD Legal and Training Bureaus on compliance issues to be addressed through training
  • Liaise with personnel to review documents and Body Worn Camera video related to Stop Question and Frisk law, and assist staff members in the proper application of NYS law by phone
  • Train and advise Professional Standards Division personnel on 4th Amendment law and laws of investigative encounters in compliance with all related NYPD policy and court ordered training materials
  • Recommend areas for policy improvement and risk management
  • Provide guidance on legal issues that affect the Early Intervention Program
  • Assist in the data gathering and preparation for ComplianceStat and other internal compliance meetings, including reviewing BWC videos and providing an assessment of the legality of officers' conduct
