About The Position

The New York City Police Department's Professional Standards Division is seeking a qualified Agency Attorney III to support its mission of enhancing the quality of life in New York City. This role involves applying a systematic approach to developing and implementing compliance mechanisms, conducting objective evaluations to reduce risk and improve operations, and devising corrective solutions for non-compliance. The division ensures individual and institutional compliance with Department policy, applicable laws, and external oversight. This position will report directly to the Executive Director of Compliance and Development and will partner with the Training Bureau and Deputy Commissioner, Legal Matters to implement recommendations from oversight bodies, including developing training programs and other corrective solutions.

Requirements

  • Admission to the New York State Bar.
  • One year of satisfactory United States legal experience subsequent to admission to any state bar.
  • Six months of satisfactory service as an Agency Attorney Interne (30086).
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
  • To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
  • To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Responsibilities

  • Conduct legal research on critical criminal law and procedure topics such as car stops and search and seizure law.
  • Draft memorandum of law to address legal questions related to Investigative Encounters.
  • Advise command leadership on changes to relevant criminal laws and emerging trends.
  • Communicate and coordinate with the NYPD Legal and Training Bureaus on compliance issues to be addressed through training.
  • Liaise with personnel to review documents and Body Worn Camera video related to Stop Question and Frisk law, and assist staff members in the proper application of NYS law by phone.
  • Train and advise Professional Standards Division personnel on 4th Amendment law and laws of investigative encounters in compliance with all related NYPD policy and Court Ordered training materials.
  • Recommend areas for policy improvement and risk management.
  • Provide guidance on legal issues that affect the Early Intervention Program.
  • Assist in the data gathering and preparation for ComplianceStat and other internal compliance meetings, including reviewing BWC videos and providing an assessment of the legality of officers' conduct.
