The Senior Counsel, Market Access position will have responsibility for supporting BMS’s US Market Access, Pricing & Value Demonstration (MAx) organization. The role will provide legal support to the MAx Access Strategy and select Access Field Teams, including support for development and execution of market access strategies (both individual product and portfolio), access related promotional review, field engagement, market research, and state drug price transparency. Additionally, this person will provide legal advice on issues related to BMS’s participation in the 340B program. Senior Counsel will be providing legal advice and counsel on US pricing and US policy issues and will operate as part of the Law Department focusing on providing excellent, pragmatic, solution-oriented services to clients.

Requirements

  • Minimum education of a law degree from an accredited US Law School is required.
  • Minimum of ten (10) years of legal experience advising the healthcare/pharmaceutical industry on legal, regulatory and/or compliance.
  • Successful experience in cross-functional interactions is required.
  • Must have experience in healthcare law, including advertising and promotion, anti-kickback and bribery laws, regulatory policy, and contracts.
  • Demonstrated ability to establish and maintain strong relationships across the business and within the Law Department.
  • Superior personal integrity and ethics, including an exceptional sense of discretion.
  • Ability to communicate complex issues clearly, verbally and in writing.

Nice To Haves

  • Legal experience in US market access, patient support programs, sales or marketing is preferred.
  • Knowledge of US healthcare laws as they relate to drug pricing and the 340B program preferred.

Responsibilities

  • Provision of proactive, practical, solution-oriented legal advice to help BMS appropriately structure, operationalize and communicate BMS’s market access strategy.
  • Serve as the primary legal point for MAx Access Strategy and select Access Field teams providing strategic counsel and advice on patient support program materials.
  • Serve as legal advisor for the MAx team as it relates to 340B program operations.
  • Collaborate across Neuroscience, Dermatology, CV, Immunology, Hematology & Oncology legal colleagues and Law Department matrix to ensure delivery of seamless, comprehensive legal advice.
  • Leverage knowledge of emerging legal and industry issues and trends to inform advice and address potential legal risk.
  • Anticipate and proactively identify legal issues applying an enterprise view and provide clear and effective legal advice that supports informed decisions.
  • Deliver effective presentations to Law Department/ MAx Department.
  • Lead and organize functional or substantive working groups assessing significant legal issues.
