Job Description The Patent/IP (intellectual property) Attorney Expert provides legal advice and counsel for a broad range of businesses and moderately complex/moderately sensitive issues, particularly patent preparation and prosecution, open source, and IP counseling. In this role, the employee drives execution of key strategies within the department, discipline, or team, and supports enterprise wide matters relating to intellectual property, technology, cybersecurity, AI, commercial, risk management, and/or data management. The Patent/IP Attorney Expert will also interview inventors, conduct patent harvesting sessions, and prepare and prosecute patent applications before the United States Patent & Trademark Office (USPTO). Requirements

  • Bachelor’s degree in a technical field; degrees in Electrical Engineering, Computer Science, or Physics are particularly relevant in this role.
  • Juris Doctor (JD) from an accredited U.S. law school.
  • USPTO registered patent attorney.
  • 5+ years of patent drafting and prosecution experience in a law firm or technology company.
  • Experience counseling business partners on open source software and data matters.
  • Ability to work within a remote office environment, and occasional travel based on needs of the business.
  • Admitted to practice law in at least one US state
  • Registered patent attorney with the USPTO

Nice To Haves

  • Backgrounds in Electrical Engineering, Computer Science, or Physics, as well as experience with machine learning, AI, software, telematics, sensors, and insurance related technologies, are particularly relevant in this role.

Responsibilities

  • Oversee the preparation and prosecution of patent applications, and work with business partners to identify inventions requiring patent protection.
  • Perform all aspects of patent prosecution, including drafting and filing office action responses, preparing high quality patent claim amendments, conducting examiner interviews, and providing direction on prosecution strategy.
  • Develop and counsel business partners on strategies for protecting company innovations through patents and supporting related business initiatives.
  • Advise business partners on legal issues related to open source software and data.
  • Draft, review, and negotiate moderately complex matters and agreements, including NDAs (non-disclosure agreements), license agreements, and technology agreements.
  • Analyze and advise business partners on freedom to operate matters.
  • Play a key role in complex projects, collaborating across legal teams within Law and Regulation with business clients, as appropriate.
  • Coordinate, interpret, and synthesize legal advice from other attorneys within Law and Regulation.
  • Advise business partners on emerging business issues, legal topics, IP matters, and risk management.
  • Anticipate legal concerns and provide practical, creative problem solving in a dynamic business environment.
