About The Position

This position manages the Healthcare Practice Group and supervise attorneys serving as counsel to the Division of State Group Insurance. This position serves in a managerial capacity over all litigation and litigation-related matters, requests for legal advice or opinions, rulemaking, and legislative analyses handled by the attorneys within the Healthcare Practice Group. This includes serving as the agency’s HIPAA Compliance Officer. This position may also represent DMS in administrative and judicial proceedings and/or serve as a Hearing Officer for informal hearings for the Division of Retirement. This position provides the opportunity to develop a competency in the areas of law under his/her purview and provide competent legal advice and counsel to the Department on a wide variety of issues, which includes the complex statutes, rules, and regulations affecting all facets of the State Group Insurance program and other plans administered by the Division of State Group Insurance. The program area that this position supports work in is a fast-paced, ever-changing environment, allowing the attorney ongoing exposure to new subject matter and the unique opportunity to assist with structuring and implementing new programs in compliance with both Florida and federal law. The Office of General Counsel also supports attorney development by providing Continuing Legal Education opportunities and allowing its attorneys to gain exposure to, and cross-training for, other highly specialized areas of the law that the office assists with by promoting collaboration and cross-training in these highly specialized areas (e.g., real estate, employment and labor relations, and cybersecurity). Ultimately, this position will allow the right candidate the opportunity to grow professionally while working alongside a team of talented and professional attorneys in a collegial atmosphere.

Requirements

  • Ability to work independently and coordinate the work activities of reporting attorneys.
  • Excellent written and verbal communication skills.
  • Ability to collect, evaluate, and analyze data.
  • Ability to plan, organize, coordinate, and timely complete assignments.
  • Ability to use logic and analysis to identify the strengths and weaknesses of different approaches.
  • Ability to establish and maintain effective working relationships with others.
  • Knowledge of laws, rules, legal codes, court procedures, precedents, government regulations, executive orders, and agency policies and procedures or ability to thoroughly research such.
  • Basic proficiency in office information technology.
  • A juris doctor from an accredited law school.
  • Admission to, and good standing with, The Florida Bar.
  • At least three years of experience as a licensed attorney.
  • At least two years of litigation and/or healthcare experience.
  • Ability to sit or stand for extended periods of time.

Nice To Haves

  • Experience with counseling on applicable federal and state regulatory requirements in healthcare law (e.g. ACA, PHSA, NSA, HIPPA, EMTALA, HITECH Act, ERISA, IRC); insurer and/or provider compliance is highly desired.
  • Experience with rulemaking is highly desired.
  • Experience with bill analyses is highly desired.
  • Experience with Florida’s Sunshine Law is highly desired.
