About The Position

The North Carolina State Highway Patrol's primary mission is to reduce collisions and make the highways of North Carolina as safe as possible. The NCSHP has more than 1,600 troopers who cover nearly 80,000 miles of North Carolina roadways, more than any other state except Texas. In addition to enforcing the state's traffic laws, state troopers also guide traffic during hurricane evacuations, re-route traffic around hazardous chemical spills, and they stand ready should any act of terrorism occur. State Troopers are committed to protecting North Carolina's motoring public. The NC State Highway Patrol (NCSHP) is seeking a detailed-oriented Deputy General Counsel to join our team! The Deputy General Counsel is a member of the Office of the General Counsel (OGC) and is a senior legal advisor for the NC State Highway Patrol (NCSHP). The Deputy General Counsel serves as second in command for the General Counsel and provides critical back-up coverage to the General Counsel on department-wide legal and policy matters. This position assists the General Counsel in addressing the vast array of legal issues affecting the department on a daily basis.

Requirements

  • Licensed to practice law by the North Carolina State Bar AND four years of progressively responsible professional legal experience.

Responsibilities

  • Assist the General Counsel and other members of the General Counsel’s office in providing legal advice, liability prevention strategies, and risk management services for the NCSHP, including developing or refining short and long-term plans concerning any facet of agency operations.
  • Provides legal advice regarding highly complex statutes, constitutional issues, and unique issues with limited or no legal precedent.
  • Handles providing legal counsel and representation on the NCSHP’s most complex, novel, and sensitive legal issues.
  • Assists the General Counsel in providing legal counsel and consultation to executive management as it selects strategic managerial courses of action and when management is resolving major, highly technical, or sensitive operational and programmatic challenges.
  • Provides legal advice and support to the General Counsel and NCSHP which includes personnel and operational guidance and advice; litigation and risk management monitoring and assistance; and reviewing operational policies and procedures and recommending revisions to legislation, rules, and policies and procedures considering changes in federal and State case law and statutes.
  • Responds to legislative inquiries and drafts proposed legislation and agency rules.
  • Reviews as necessary responses to public records requests, subpoenas, and petitions for release of custodial law enforcement agency recordings.
  • The position also drafts or reviews departmental policies and contracts.
