About The Position

Equal Opportunity, Compliance & Title IX is seeking qualified applicants to join a pool of part-time, impartial Title IX Hearing Officers. Individuals in this pool will be engaged on an as-needed basis to review case materials, preside over formal Title IX hearings, make relevancy determinations, and issue written decisions regarding responsibility and sanctions in matters involving allegations of Title IX sexual harassment or sexual assault by or against University students or employees. Hearing Officers serve as neutral, trained decision-makers responsible for ensuring a fair, transparent, and compliant hearing process in accordance with federal Title IX regulations (34 C.F.R. §106.45) and University policy.

Requirements

Juris Doctor (J.D.) awarded from an accredited institution
At least five (5) years of experience presiding over or representing parties in court or administrative proceedings
Active membership in good standing with the Bar of the State of Arkansas or another U.S. jurisdiction

Nice To Haves

At least five (5) years of experience involving criminal, employment, or student-conduct legal proceedings
Working knowledge of Title IX, the Violence Against Women Act (VAWA), and employment law
Demonstrated ability to render fair, well-reasoned administrative decisions on sensitive, complex matters
Experience conducting neutral or trauma-informed hearings

Responsibilities

Preside over live hearings, ensuring compliance with applicable law, federal Title IX regulations, and University procedures.
Maintain impartiality and avoid conflicts of interest or bias for or against complainants, respondents, or their advisors.
Determine the relevancy of each cross-examination question before it is answered and clearly articulate the basis for each decision.
Assess the credibility of witnesses, analyze all evidence submitted, and determine the facts of the case as applied to University Title IX policy.
Apply the preponderance of the evidence standard to determine whether a policy violation occurred.
Prepare and issue the required written determination of responsibility, including the findings of fact, conclusions regarding the application of University policy, the rationale for each finding, any disciplinary sanctions imposed on the respondent, and the remedies provided to restore or preserve the complainant’s equal access to University programs or employment.
Impose appropriate disciplinary sanctions when finding responsibility for a policy violation.
Determine and describe remedies designed to restore or preserve the complainant’s access to educational programs or activities.
Utilize University-designated technology to conduct hearings in person, remotely, or in hybrid format, ensuring parties are able to participate fully and simultaneously.
Participate in all required University training
Regular, reliable, and non-disruptive attendance is an essential job duty, as is the ability to create and maintain collegial, harmonious working relationships with others.
