The Role Capital One’s Legal Department is seeking an experienced attorney to join our employment law team in Richmond, Virginia or McLean, Virginia. The attorney in this position will focus on providing employment law advice for Capital One’s international footprint. The attorney in this role will work closely with business leaders and the Human Resources department to provide legal guidance, ensure compliance with internal policies and procedures and international employment laws and regulations, and manage litigation risks. Responsibilities of this position will include, but will not be limited to providing strategic legal counsel on: Implementing HR policies and practices globally; Strategies for new country entry, including legal entity structure and establishment; Providing employment law advice to locations outside the US; and Coordinating global efforts to provide strategic legal advice to enterprise HR functions. The role requires an attorney with intellectual curiosity, a desire to learn new areas of law, and an interest and an ability to analyze and interpret laws, regulations, and other source documents covering many different areas of international employment law. As the role supports a wide range of jurisdictions and subject matters, you will ideally have experience in several of the areas detailed in this posting, plus a growth mindset to tackle new issues across emerging areas of the law as you help solve complex problems. This role also requires an attorney with outstanding judgment, a strong interest and proficiency in the use of modern technology, and with strong analytical, organizational, and prioritization skills. Additionally, this role requires an attorney possessing excellent verbal and written communication skills, attention to detail, the ability to interact with and influence associates across departments and job levels, and the ability to work effectively in a fast-paced environment, with minimal supervision, while managing large volumes of work including complex legal issues that may arise suddenly. The attorney will also be expected to advise clients on proactive approaches to mitigating legal risk. This position will be a part of a larger, dynamic team supporting Human Resources advice and litigation and will report to the Senior Director, Associate General Counsel.

Requirements

  • Juris Doctor from an accredited law school
  • Active member in good standing of at least one state bar
  • At least 4 years of experience as an attorney in a law firm environment, at a government agency, as a military judge advocate, or as in-house counsel
  • Intellectual curiosity
  • A desire to learn new areas of law
  • An interest and an ability to analyze and interpret laws, regulations, and other source documents covering many different areas of international employment law

Nice To Haves

  • 5+ years of experience in an AmLaw 100 law firm or an in-house legal department at a multinational company
  • Deep expertise in global employment law (advice regarding employment and expansion strategies, drafting HR policies and procedures, employment agreements, etc.)
  • Experience in litigating or managing litigation of employment law and restrictive covenant claims
  • Experience investigating and responding to employment-related complaints to local agencies, and responding to government investigations and audits of employment-related practices
  • Experience conducting internal investigations of employment law complaints
  • Experience reviewing M&A due diligence
