Requirements

  • JD from an accredited US law school and licensed to practice
  • Minimum of 8-10 years of experience, preferably within medical device, pharma or healthcare industries
  • Thorough knowledge of the False Claims Act, Stark Law, Anti-Kickback Statute, and anti-bribery and corruption laws
  • Excellent communication, negotiation and interpersonal skills, with the ability to work collaboratively across departments and international teams
  • Able to work under pressure with a high level of integrity, professionalism and judgment in handling sensitive and confidential information
  • Willing to be hands and roll up your sleeves as needed to navigate between day-to-day tasks and key strategic projects and topics
  • Proficiency with Microsoft Office required

Nice To Haves

  • Knowledge of compliance risks and considerations related to healthcare sales and marketing activities, including interactions with healthcare professionals and customers and promotional activities is highly desirable
  • Familiarity with global advertising standards and promotional guidelines

Responsibilities

  • Develop and maintain the full legal strategy for the North America region ensuring alignment with global embecta strategies.
  • Provide accurate, relevant and timely legal advice and counseling to the full North America businesses and functions (e.g., sales, marketing, finance and HR) and their leaders on all legal topics.
  • Independently draft, edit, and negotiate a variety of contracts, including GPO contracts, RFPs, sales agreement, service agreements, distribution agreements, and non-disclosure agreements.
  • Work closely with colleagues and leadership to ensure adherence to applicable laws related to general commercial, regulatory, employment, consumer and data security requirements, as well as compliance with company policies and procedures.
  • Be accountable for effective and efficient utilization of related legal expenses and outside counsel, including projections and managing budgets.
  • In partnership with the central Promotional Review Committee, conduct thorough reviews of global advertising and promotional materials, ensuring they meet regulatory standards and guidelines.
  • Provide training and education for stakeholders to ensure proper functioning and transparency of contractual and other processes.
  • Provide accurate information and research to the Sr. Director, North America Commercial and Head of Global Ethics, Compliance and Privacy and other members of the Legal & Compliance Department regarding laws and regulations.
  • With the Sr. Director, North America Commercial and Head of Global Ethics, Compliance and Privacy, manage litigation cases across the North America region.
