About The Position

This Senior Assistant Attorney General position is in the Office of the Attorney General within the Capital Collateral Unit in West Palm Beach, Flrodia.

Requirements

  • Admission to the Florida Bar and six (6) years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.
  • The required legal experience must be from the practice of law in a state or territory of the United States.
  • Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

Responsibilities

  • Represent the state in capital collateral litigation prosecuting first-degree murder cases where the death penalty has been imposed.
  • Serve as the lead counsel or co-counsel in the state circuit courts and Florida Supreme Court, as well as represent the state in habeas actions in federal district courts, the Eleventh Circuit Court of Appeals, and United States Supreme Court.
  • Capable of handling lead chair responsibility for any active death warrant.
  • Litigation includes attendance at evidentiary hearings at all post-conviction and appellate stages, research, preparation of briefs, responses, motions, and other functions directly related to appeals (capital direct appeals, interlocutory actions, collateral appeals, and extra-ordinary writs).
  • Handle emergency circumstances such as preparing pleadings and appearing in court, at all levels of state and federal courts, including during the pendency of an active death warrant.
  • Responsibility also includes keeping current on all state and federal decisions directly or indirectly impacting capital cases. This includes becoming familiar with all capital cases in the office and maintaining a communications network with other capital specialists in other offices.
  • Provide advice and assistance to other attorneys with legal analysis, brief preparation, and other attending responsibilities.
  • MENTORING: Assist the Bureau Chief as needed in reviewing the work of staff and mentoring AAGs and A-AAGs.
  • Communicate with the Associate Deputy, State Attorney offices and court personnel concerning case matters as needed in the Bureau Chief’s absence.
