Metrolinx is connecting communities across the Greater Golden Horseshoe. Metrolinx operates GO Transit and UP Express, as well as the PRESTO fare payment system. We are also building new and improved rapid transit, including GO Expansion, Light Rail Transit routes, and major expansions to Toronto’s subway system, to get people where they need to go, better, faster and easier. The Program Management Office in our Capital Projects Group is hiring a Manger CPG Claims to provide leadership and expertise in the management of the claims process to support the Capital Projects Group’s delivery of capital and infrastructure projects, including managing the implementation of a claims governance framework, claims management policies and procedures and a claims management training program.

Requirements

  • Completion of a degree in construction management, project management, engineering, quantity surveying or a related discipline – or a combination of education, training and experience deemed equivalent.
  • Demonstrated experience in major project claims management; progressive experience in the management and administration of major construction/infrastructure contracts in a public sector environment.
  • Commercial or Quantity Surveying experience in the construction industry is an asset 
  • Certifications or Designations Active membership in PEO, AACE, PMI, CIQS, RICS, CIArb or similar association is an asset.
  • Knowledge of claims management policies, principles, procedures and industry best practices to manage the claims management process.
  • Experience in preparation and/or evaluation of variety of claims including delay, disruption, loss of production, acceleration and scope changes, including schedule analysis.
  • Ability to read engineering drawings, review construction schedules, validate cost & quantum calculations for direct and indirect costs.
  • Knowledge and understanding of Construction methodologies and Contractor’s tender pricing, involving pricing of temporary and permanent works, risks & contingency allocations, overheads and escalation pricing.
  • Knowledge and understanding of alternative dispute resolution techniques and good negotiation skills to arrive at fair settlements on claims.
  • Experience in coordinating the claim management process with project teams, consultants, external experts and legal counsel is an asset.
  • Knowledge of contract administration and project delivery using AFP, P3, or design/build methodology, associated contracting terms & risk transfers and an understanding of relevant contract law/regulations is desirable.
  • Good understanding and knowledge of the practical application of contract administration and document management software, CM14, Aconex, ProjectWise, Unifier and SharePoint.
  • Ability to understand construction schedules and familiarity with scheduling software like Primavera P6, Microsoft Projects and/or Tilos.
  • Experience in managing and mentoring contract teams involving, claim analysts, forensic schedulers and contract administrators.

Responsibilities

  • Manages the claims management team responsible for advising and assisting the project delivery teams to ensure that claims are settled in a timely manner.
  • Leads claims evaluations and negotiations staff to effectively manage, evaluate and resolve claims, making sure procedures are adhered to and the necessary due diligence is applied at all stages.
  • Leads the claims management process on multiple Metrolinx transit and infrastructure projects, including management and maintenance of claims documentation/records and the timely reporting of overall claims status.
  • Implements claims management governance framework, processes, and tools to support effective and efficient claims management including that for claims avoidance and mitigation.
  • Tracks and ensures claims packages (i.e., supporting documentation) are completed expeditiously.
  • Recommends elevation of Claims to Central Claims Team, as required.
  • Assists in the preparation and presentation of summary reports and supporting documentation for Executive Management.
  • Provides input to the Project Delivery Teams on claims avoidance and mitigation techniques and involves other functional disciplines (scheduling practices, records maintenance, risk management, contract administration, legal etc.), as required.
  • Supports the Senior Claims Manager during the negotiation and resolution phase and also in coordinating alternate Dispute Resolution processes such as mediation, arbitration and litigation.
  • Investigates, evaluates, and provides recommendations for the negotiated settlement of claims and prepares position papers to recommend solutions to contractual issues and claims settlement.
  • Contributes to the development and assists in the administration of claims management policies, procedures, and practices.
  • Leads implementation of a claims management training program for frontline staff on the Project Teams, contractors, and Metrolinx executives.
