About The Position
Our client is a law firm seeking an L&M Appeal Attorney responsible for drafting appellate briefs, motions, applications, and complex pleadings on CAPIC-litigated matters. The attorney will provide advice and assistance through all phases of litigation, including cost-effective motions for early dismissal, trial, and post-trial motions. The role involves assessing key issues, rendering opinions, and delivering results. The ideal candidate will be an experienced legal draftsperson with highly developed legal writing skills and an in-depth knowledge of trial and appellate courts as they apply to motion practice in medical malpractice defense.
Requirements
- License to practice law in California.
- Computer proficiency.
- Proficiency in online legal research.
- Excellent legal writing skills.
- Ability to work independently.
- J.D. Degree
Responsibilities
- Appeals Designate, review, and analyze lower court records and related documents.
- Monitor appellate dockets.
- Research and analyze case law and draft persuasive briefs, appellate motions, and applications.
- Advocate in appellate courts.
- Assist in-house and outside trial counsel in framing issues at trial and preserving the record for appeal.
- Advise trial counsel and claims specialists regarding writ petitions.
- Support Law and Motion Team Prepare pleadings.
- Provide support to attorneys in litigation matters to successfully try and arbitrate cases.
- Formulate creative pleading and motion strategies.
- Obtain concurrence with claims specialists and attorneys for law and motion pleadings and strategy.
- Attend court appearances and argue motions.
- Assist in compliance with the Defense Attorney Guidelines.
