About The Position

The Law Clerk provides professional legal support to Assistant United States Attorneys (AUSAs) within the Criminal and Civil Divisions. This role involves conducting legal research, drafting legal documents, analyzing case law and statutes, and assisting attorneys with case preparation. The Law Clerk supports the Department of Justice’s mission to prosecute criminal cases, represent the United States in civil litigation, and enforce federal laws. The position does not involve representing the United States in court, but provides legal and analytical support for ongoing litigation matters.

Requirements

  • Juris Doctor (J.D.) from an accredited law school
  • Licensed member of a state bar
  • Minimum 1 year of post-J.D. professional legal experience or relevant legal work experience.
  • Strong legal research and writing skills.
  • Experience using legal research tools such as Westlaw, LexisNexis, CourtLink, or similar platforms.
  • Proficiency in Microsoft Office (Word, Excel, PowerPoint, Outlook).
  • Ability to analyze complex legal issues and synthesize large amounts of legal information.
  • Strong interpersonal and communication skills to interact with attorneys, court personnel, and other stakeholders.
  • Ability to manage deadlines and work on multiple cases simultaneously.
  • U.S. Citizenship required
  • Ability to obtain and maintain a Public Trust background investigation clearance.

Responsibilities

  • Legal Research & Analysis
  • Conduct research and analysis of statutes, legislative history, judicial precedents, agency regulations, and legal publications.
  • Evaluate complex legal issues and provide research findings to support attorneys in ongoing cases.
  • Case Support
  • Assist Assistant United States Attorneys with case preparation by summarizing facts, identifying legal issues, and providing relevant case law.
  • Review and analyze case files to identify potential legal defenses, violations, or causes of action.
  • Legal Writing
  • Draft legal correspondence, memoranda, and other legal documents for attorney review and signature.
  • Prepare proposed orders for judges and magistrates.
  • Habeas Corpus & Immigration Case Management
  • Manage and monitor matters related to 28 U.S.C. §2255 (habeas corpus) and immigration habeas cases, including:
  • Receiving and docketing filings
  • Tracking deadlines and court schedules
  • Coordinating with attorneys and support staff
  • Preparing draft responses for attorney review
  • Ensuring timely filings with the court.
  • Legal Compliance & Updates
  • Maintain awareness of changes in federal, state, and local laws affecting criminal and civil litigation.
  • Alert attorneys to potential legal issues identified during case analysis.
  • Additional Duties
  • Provide general litigation support as needed.
  • Perform other related legal support duties assigned by supervising attorneys within the scope of the position.
