About The Position

As a Labor Law Enforcement Officer, you will apply state and federal labor laws to protect workers, promote equal opportunity, and ensure compliance with employment regulations. Within this role, you'll support the construction industry by conducting on-site inspections to enforce Delaware’s Prevailing Wage, Workplace Misclassification, and Contractor Registration laws and regulations. You will make determinations, issue civil penalties, resolve cases through mediation and negotiation, and support administrative proceedings by providing testimony. Through your investigative work, you'll provide education to employers and the community on Delaware's Labor Laws, promoting compliance and awareness. Requirements

  • Applicants must be legally authorized to work in the United States.
  • All new hires are required to report to the Statewide New Employee Orientation (SNEO) on their first day of employment.
  • Applicants must have education, training and/or experience demonstrating competence in each of the following areas:
  • One year experience in conducting investigations which includes conducting interviews to obtain confidential information, gathering evidence, and documenting findings.
  • Six months experience in resolving labor law or employment discrimination complaints.
  • Six months experience in interpreting laws, rules, regulations, standards, policies, and procedures.
  • Six months experience in narrative report writing.
  • Three years experience in conducting investigations which includes conducting interviews to obtain confidential information, gathering evidence, and documenting findings.
  • Three years experience in resolving labor law or employment discrimination complaints.
  • Three years experience in interpreting laws, rules, regulations, standards, policies, and procedures.
  • Two years experience in developing and conducting staff training.
  • Two years experience in narrative report writing.

Responsibilities

  • Investigates and resolves complaints and enforces various state labor standards and civil rights laws.
  • Advises employers, employees, attorneys and other interested parties of the applicability and interpretation of the various laws; provides information to the general public regarding labor standards and civil rights laws, regulations and filing procedures.
  • Gathers, examines, and interprets data such as payroll, medical and other records to determine amount due; collect wages and benefits if applicable.
  • May participate in annual prevailing wage survey of contractors; provides prevailing wage determinations to governmental entities, contractors, architects, contracting agencies and others requesting information.
  • Prepares case summaries, reports, and correspondence for cases.
  • Maintains records of complaints received and disposition of cases.
  • Keeps abreast of changes in the law, new interpretations; attends training seminars or conferences.
