About The Position

The Fair Banking Officer provides oversight of the Bank’s Fair Lending, Community Reinvestment Act, and Unfair, Deceptive, or Abusive Acts or Practices, (UDAAP) programs. This oversight also includes the management of the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act (FHA). This position is responsible for the development, implementation, and ongoing monitoring of the Bank’s Fair Banking framework to ensure compliance with applicable laws, regulatory guidance and supervisory expectations. The Officer serves as a subject matter expert and advises executive management and the Board, ensuring fair banking risks are identified, measured, monitored and controlled in alignment with the Bank’s risk appetite and strategic objectives.

Requirements

Bachelor’s degree in business administration, finance, or related area, advanced degree preferred.
Minimum five years’ experience working with state and federal banking laws, regulations and acts, particularly fair banking requirements.
Extensive supervisory and managerial skills to effectively administer the compliance program across departmental lines.
Ability to read, analyze, and interpret the most complex documents.
Ability to respond effectively to the most sensitive inquiries or complaints.
Ability to write speeches and articles using original or innovative techniques or style.
Ability to make effective and persuasive speeches and presentations on controversial or complex topics to top management, public groups, and/or boards of directors.
Ability to work with mathematical concepts such as probability and statistical inference, and fundamentals of plane and solid geometry and trigonometry.
Ability to apply concepts such as fractions, percentages, ratios, and proportions to practical situations.
Ability to apply principles of logical or scientific thinking to a wide range of intellectual and practical problems.
Ability to deal with a variety of abstract and concrete variables.
Intermediate personal computer skills including electronic mail, word processing, spreadsheet, graphics, etc.
Ability to prioritize, organize, and delegate assignments.
Manual dexterity is sufficient to reach/handle items and work with fingers. Works with fingers and perceives attributes of objects and materials.
Must be able to remain in a stationary position 90% of the time.
The person in this position needs to occasionally move about inside the office to visit other offices, conference rooms, office machinery, etc.
Constantly operates a computer and other office productivity machinery, such as a calculator, copy machine, and telephone.
Constantly positions self to operate on a computer.
The person in this position frequently communicates with other people throughout each day. Must be able to exchange accurate information when conversing.
Well-lighted, heated and/or air-conditioned indoor office setting with adequate ventilation.
Moderate noise (e.g. business offices with computers and printers, light traffic).
Monday through Friday; 8:00am – 5:00pm.
Available for overtime, as needed.

Responsibilities

Strategic oversight of the CRA, Fair Lending, and UDAAP compliance risk management functions.
Consults with business managers to identify risks, best practices and expectations pertaining to Fair Lending laws, the CRA and UDAAP.
Assists as a liaison with regulatory agencies and external auditors for CRA, Fair Lending and UDAAP examinations/audits. Oversees the Complaint Program which includes the tracking, monitoring, and reporting of complaints.
Coordinates and completes the annual fair lending, UDAAP, ECOA, CRA and FHA risk assessments.
Oversees the periodic analysis of fair lending and CRA monitoring reviews to identify potential risks.
Manages and directs all data collection governance to support robust fair analysis.
Monitors complaints, advertisements, loan approval and denial documentation, and all applicable consumer-related forms to identify fair banking risks.
Oversees the completion of the periodic Fair Lending internal reviews in accordance with the FFIEC Examination Procedures.
Oversees CRA Data collection, validation, and the annual Loan Register submission.
Conducts ongoing assessment of community credit needs within the Bank’s assessment areas.
Tracks and maintains all community development activities including donations, investments, services, and loans.
Completes the self-assessment of the Bank’s CRA performance with the assistance of the Assistant CRA Officer.
Oversees the Community Commitment Awards program designed to encourage the increase of CRA qualified services.
Establishes and maintains relationships with community based, charitable, and non-profit organizations.
Assesses needs in each of the Bank’s assessment areas and develop action plans that make the most effective CRA impact.
Assists the Training Department with the development and roll-out of CRA, Fair Lending, and UDAAP training for the Bank’s team members.
Works with the Associate Chief Compliance Officer for effective resolution of consumer complaints relating to fair banking issues.
Maintains an up-to-date knowledge of evolving bank laws and regulatory expectations particularly those affecting fair banking practices.
Maintains current knowledge of lending products, programs, operations, systems, and controls.
Collaborates with lending personnel to evaluate proposed business changes, including new or modified products/services, new or modified policies, procedures, processes, or systems to ensure compliance with applicable fair banking-related laws and regulations.
Prepares the quarterly Fair Banking Report and presents to the Board level Compliance, IT and CRA Committee.
Coordinates and documents remedial actions required for corrective action and resolution to possibly include root cause analysis.
Oversee the Fair Banking Working Group which provides timely results on reviews, emerging risks, and innovative opportunities to executive management.
Assists in the coordination of regulatory compliance exams and audits as necessary.
Coordinates and participates in applicable committee meetings and any related subcommittees.

Performs duties in compliance with applicable laws and regulations, including but not limited to the Bank Secrecy Act (BSA) and related anti-money laundering laws, and in accordance with the Bank’s Information Security Program.
