About The Position

We are seeking a highly motivated, hard working, and experienced Counsel, Intellectual Property to join our dynamic legal team. This role will report to the VP, Chief IP Counsel and will be instrumental in protecting Insulet’s cutting-edge innovations in wearable medical devices, software, and digital health technologies. The ideal candidate will preferably have an educational background in software-related technologies, experience at reputable law firms, a background in medical devices, and strong experience in IP litigation, patent drafting and prosecution, and IP transactions.

Requirements

  • J.D. from an accredited U.S. law school and admission to practice before the USPTO and at least one U.S. state.
  • Minimum of 6 years of experience in patent law, preferably with a top-tier law firm and/or in-house legal department.
  • Strong experience in IP litigation, patent drafting and prosecution, and negotiating IP agreements required.
  • Bachelor’s degree; Degree in Computer Science, Computer Engineering, or a closely related field is preferred.
  • Strong understanding of software patentability, AI/ML, and digital health technologies.
  • Knowledge and experience with open source software and ability to advise engineering teams on managing OSS.
  • Excellent communication, analytical, and project management skills.
  • Ability to work independently and collaboratively in a fast-paced, mission-driven environment.

Nice To Haves

  • Experience as a patent examiner is a plus.
  • Experience with medical devices, wearable technologies, or regulated healthcare products is strongly preferred.
  • Other engineering degrees will be considered in light of other relevant experience.

Responsibilities

  • Provide strategic IP counseling to R&D, product franchises, marketing, and other functions within Insulet, particularly in the areas of software, algorithms, OSS, machine learning, and digital health.
  • Manage a global patent portfolio aligned with Insulet’s business objectives, including drafting and prosecuting patent applications, working with outside counsel.
  • Conduct freedom-to-operate, patentability, and infringement analyses.
  • Support global IP litigation, oppositions, and enforcement efforts as needed.
  • Assist with and negotiate IP-related aspects of transactions, including licensing, M&A, and collaborations.
  • Manage a global trademark portfolio: from advising marketing team, clearance searches, specimen submissions, and registration maintenance.
  • Educate internal stakeholders on IP best practices and emerging trends.
  • Perform each of these key responsibilities with a high degree of strategic and long-term thinking.
