About The Position

The Oregon Liquor and Cannabis Commission (OLCC) is recruiting for a permanent, full-time Case Presenter in our Administrative Hearings Division. Case Presenters ensure efficient and effective operations of administrative hearings for OLCC cases. This position evaluates proposed agency actions from Compliance, Licensing, and Retail Services Divisions for cases where enforcement actions, licensing refusals, or contract actions are recommended; proposes and drafts Notices initiating the contested case hearing process; implements a course of action for resolving the case, through settlement, withdrawal, or conducting a contested case hearing; writes Final Order of Default in appropriate cases; represents the Commission in contested case hearings and at Commission meetings by preparing the case for hearings, attending pre/post-hearing conferences, presenting the case at hearings, reviewing proposed orders, writing comments, and presenting oral argument at Commission meetings; provides technical assistance and quality assurance to the Public Safety Services Program, and analyzes issues for policy-makers’ decisions. While this recruitment is an internal and external opportunity, internal OLCC applicants will be given preference during the application review process. The Oregon Liquor and Cannabis Commission (OLCC) oversees access to alcohol and cannabis products in Oregon through education, regulation, and distilled spirits distribution. The agency is comprised of three major operational programs: the Distilled Spirits Program, the Recreational Marijuana Program, and the Public Safety Program. Requirements

  • A JD degree and one year of legal experience analyzing, researching, and drafting legal documents, evaluating evidence, and interviewing clients; OR A bachelor’s degree in a related field and three years of experience drafting and handling administrative actions or contested cases (civil penalties and orders) to include analyzing, researching, and drafting legal documents, evaluating evidence, and interviewing clients; OR Six years of direct experience drafting and handling administrative actions or contested cases (civil penalties and orders) to include analyzing, researching, and drafting legal documents, evaluating evidence, and interviewing clients.

Responsibilities

  • Review assigned cases for legal sufficiency by conducting thorough research of statutes, rules, case precedent, and policies related to the Agency’s enforcement and regulatory functions; analyzing evidence gathered during investigations by Agency staff, local government and other sources; identifying any additional, necessary investigation and/or documentation by Agency staff; notifying Agency staff of the need for any such additional work, providing assistance as necessary.
  • Assure reports from Agency staff and managers are complete and reflect decisions consistent with past practice and case precedent.
  • Evaluate cases for further processing.
  • Make independent decisions to charge violations, propose licensing action, or decline to take administrative action based on analysis and evaluation of the case.
  • Manage and organize caseload using agency’s case management program, according to technical guidance and operating procedures.
  • Collaborate with hearings division staff to issue documents and in preparation for hearings and settlements.
  • Evaluate cases for settlements.
  • Advises agency management on relative cost and benefits of various enforcement policy options.
  • Negotiate settlements with applicants, licensees, permittees, liquor agents, or their attorneys to dispose of violation charges, licensing or permitting actions, and retail sales agreement violations.
  • Prepare cases for hearing by identifying and coordinating testimony of witnesses, preparing direct and cross examination of each witness at hearing, and identifying all documents to be provided to the respondent party in the case summary and presented as evidence at a hearing, discovery documents, witnesses to be subpoenaed, and the information to be elicited from each witness.
  • Represent Agency in hearings, hearing conferences, Commission meetings and other proceedings as the Commission's designated lay representative.
  • Present arguments in hearings regarding: facts, application of facts to the law, comparison of prior actions of the agency, literal meaning of the applicable law and admissibility of evidence or the correctness of the procedures being followed.
