Our culture is built on positivity, creativity, and the belief that work should be fulfilling, not just a “day job.” Under general direction of the Loss Mitigation Manager, Bankruptcy and Litigation Specialist is responsible for protecting the assets of the Credit Union in bankruptcies and other legal proceedings. Maintains relevant logs and other documentation.

Requirements

  • Paralegal certification, preferably from an ABA-approved paralegal education program; or two years related experience; or equivalent combination of education and experience.
  • Understands and has a working knowledge of the following:
  • Legal pleadings
  • FDCPA and the collections process from start to finish
  • Federal, state and local laws relating to the bankruptcy process
  • Bankruptcy Trustee requirements
  • Court Electronic Document Filing System

Responsibilities

  • Assist AVP with assessing the need for outside representation and makes recommendations relating to such engagements, tracks attorney costs, and processes invoices
  • Prepare and file proofs of claims, obtain asset values, verify account information, and generate written communication
  • Review initial bankruptcy filings to determine next steps, monitors files throughout bankruptcy for issues that surface requiring motions, objections or orders while maintaining documentation and logs on all bankruptcy and litigation activities
  • Review collections from legal recommendations and send file to outside counsel; monitor and assist AVP in legal process through resolution or judgment
  • Review and respond to various garnishments received from multi-state child support agencies, IRS, TX comptroller of public affairs, LA dept of revenue, receivers, judgement creditors, and other court ordered entities
  • Assist in managing any HELOC and/or HEL foreclosures or requests. Coordinates payments of past due HOA fees, taxes, etc. if necessary.
  • Serve as a back-up to the Repossessions Specialist and/or Remarketing specialist as needed
