About The Position

The Attorney will provide legal support to the bank’s consumer mortgage, HELOC, and consumer loan default operations teams, with a primary focus on foreclosure and bankruptcy matters. This role involves advising business partners on legal risk and strategy; assisting operations leaders in their selection of and maintenance of relationships with outside counsel; ensuring compliance with federal and state laws and regulatory requirements; and handling complex issues arising from foreclosure, REO property management and disposition, and consumer bankruptcies. The Attorney will review policies and procedures; respond to escalations and litigation-related inquiries; and collaborate closely with servicing, risk, compliance, and operations teams to support efficient, compliant, and customer focused resolution of defaulted loans while protecting the bank’s legal and reputational interests. The attorney will maintain strong, productive relationships with key internal clients while serving as a trusted legal advisor, legal risk manager, and business partner. Position has in office expectations and role can sit in our Atlanta, GA, Richmond, VA or Charlotte, NC office. This is not a remote opportunity.

Requirements

  • Juris Doctorate degree from an ABA accredited law school and licensed to practice law in good standing
  • 8 years of post-bar experience in a law firm, government, and/or corporate settings.
  • Possess superior written and verbal communication skills
  • Ability to prioritize matters, utilize time management skills, and move between matters fluidly
  • Ability to handle a heavy workload, manage stress effectively and meet critical deadlines
  • Able to work autonomously without close supervision
  • Team-oriented mentality and excellent interpersonal skills
  • Demonstrated proficiency in basic computer applications, such as Microsoft Office software products

Nice To Haves

  • Experience or related training in the financial services industry or a related legal specialty
  • Experience in a corporate legal department having successfully held positions of advancing responsibility
  • An educational focus on business or finance
  • Comfortable working in the entrepreneurial environment of a large, complex corporation
  • Experience or related training in consumer mortgage and HELOC foreclosure
  • Experience in consumer bankruptcy and the impact of a bankruptcy case on consumer debt collection, foreclosure or repossession.

Responsibilities

  • Provide significant day-to-day legal support to the mortgage default operations and consumer default operations leaders and to compliance and risk partners.
  • Assess legal risk, provide legal advice, and assist in resolving legal problems which may present potential exposure to the bank.
  • Keep abreast of legislation, regulations, and case law developments relevant to foreclosure, titling of real estate, and bankruptcy. Participate in the bank’s regulatory change management process and advise clients on the impacts of changes in federal and state law.
  • Prepare and review documents and other instruments.
  • Identify need for and when necessary, select, engage, and direct outside counsel to undertake specific matters. Support default management in their selection and management of outside counsel for foreclosure and bankruptcy matters.
  • Serve as an individual contributor and provide ad hoc work direction and supervision to other legal staff regarding support on active cases or projects.
