About The Position

Summary of Position The Associate Counsel is responsible for providing legal advice to the Company concerning litigation prevention, litigation management, and legal compliance. Areas of specific emphasis include consumer transactions, safety, supply-chain and contractor relationships, as well as regulatory and other compliance matters. The Associate Counsel works closely with multiple internal clients and external relationships.

Requirements

  • Juris Doctor from an accredited law school required.
  • Licensed by the State Bar of Texas required.
  • Requires 3-5 years of relevant experience in law firm or in-house roles.
  • Demonstrated computer skills including a working knowledge of MS Office products, including Outlook, Excel, Word, and PowerPoint.
  • Regular, predictable attendance is an essential function of this position.
  • Must be regularly available and willing to work at least full workdays from Monday through Friday and such other hours as the Company determines are necessary or desirable to meet business needs.

Nice To Haves

  • Construction defect experience a plus.

Responsibilities

  • Manage and resolve all aspects of pending litigation for the company, utilizing outside counsel when appropriate, including but not limited to disputes, demands, claims, and lawsuits related to construction projects and processes (including design and construction defects, lien claims, injury claims, and payment disputes), consumer transaction and related customer disputes, and commercial disputes with suppliers, contractors, insurers, and other third parties.
  • Provide legal advice to the Company concerning, and participate with outside counsel on all aspects of pending litigation, including but not limited to discovery responses, witness preparation of Company employees, attending depositions and mediations, trial preparation, and case risk assessment.
  • Provide legal advice regarding safety program and overall safety compliance, including assistance with implementation of new safety initiatives.
  • Provide legal advice regarding compliance, including I-9 and immigration matters.
  • Review and/or prepare contracts, notices, and disclosures concerning home sales.
  • Review and provide legal advice regarding marketing materials, contracts, and home warranty issues.
  • Assist with monitoring and implementing Company’s legislative and regulatory agenda and issues as needed.
  • Conduct legal training for outside sales professionals and professional construction management staff, as needed.
  • Perform legal research as necessary to perform job duties.
  • Monitor legal developments that affect the Company’s business.
  • Must sometimes complete assignments with very short notice under extreme time constraints.
  • Other duties as assigned.
