About The Position

Attorney General Andrea Joy Campbell is looking for a highly motivated attorney to join her team as an Assistant Attorney General in the Constitutional & Administrative Law Division within the Government Bureau. The Government Bureau represents state agencies and officials in a broad range of appeals and civil litigation in state and federal courts. As part of that effort, the Constitutional & Administrative Law Division defends constitutional and other legal challenges to state statutes and regulations; suits that challenge the implementation of state policies and programs; and suits for judicial review of the decisions of state administrative agencies. Litigation in the Constitutional & Administrative Law Division reflects the breadth of state governmental activity. Recent case examples have included defending the state’s various affordable housing laws and policies, defending state gun-safety laws against Second Amendment challenges, defending state policies and rules against various forms of First Amendment challenges, and handling litigation involving education reform, health care, campaign finance, environmental permitting, transportation, and child welfare and human services programs. The Division’s cases often involve constitutional issues, questions of statutory interpretation, and claims concerning the authority of state administrative agencies. In addition to a substantial trial-court caseload, Division attorneys handle about 80 appeals each year, in the Appeals Court, SJC, and the U.S. Court of Appeals for the First Circuit.

Requirements

  • Must be a member of the Massachusetts bar or have a pending application for admission.
  • Must be a member of the bar of the United States District Court for Massachusetts or be eligible for admission in short order.
  • At least three (3) to five (5) years of relevant legal experience is preferred.
  • Familiarity with constitutional law, administrative law, civil and appellate procedure, and trial practice.
  • Effective legal writing skills and the ability to independently handle litigation in the trial and appellate courts.
  • Demonstrated interest in public service and working in a collaborative, public-law environment.
  • The successful candidate will be able to demonstrate a connection to the people and communities we serve and an interest in supporting a respectful and inclusive work environment.

Responsibilities

  • Assistant Attorneys General in the Constitutional & Administrative Law Division represent state officials and agencies in appeals and litigation in state and federal courts regarding state statutes, regulations, policies, and agency adjudicatory decisions.
